-,

City Council Meeting Minutes
September 9, 1992
page seven

City Council members shall submit comments regarding the proposed
developm~nt by Monday morning, audience members are encouraee to
do the samej the subcommittee is to meet early next week, motion
carried ~nanimously.

Draina~eiGrading Lot 1, Block 3 Peterson's Old Homestead Addition
Debra Nelson, 7164 Mill Road, appeared before the City Council to
express her concern regarding the grading between her lot and Lot
1, Block 4 of Centerville Heights. Ms. Nelson appeared to feel
that what was constructed for drainage was not what was
originally discussed. She felt that the original problem was an
oversight and it is unfortunate that it must be dealt with in
this way. Her concerns are what will it be like when there is
high water and that this could be a big problem for her in the
future. She noted that when the sod was taken out to construct
the swale, a ridge occurred in this area. She felt the builder
did a poor job from the start. She expressed disappointment in
never being contacted during the process for her opinion and to
update her. She noted the swale has not set up to run down the
middle of the easement. Because of previous oversights she does
not want the water problem to be her's. She noted that she was
there first. She advised the water does not run evenly and it is
unsightly and the sod needs to be fixed.

Mayor Buckbee noted there are drainage concerns in all of
Centerville. Centerville does not have ample elevation to
alleviate all these concerns. He advised that he would like all
parties to participate in a mediation process to try to resolve
the issues and the concerns. He noted the drainage looks like is
being taken care of even though it may not be able to completely
satisfy all parties.

Chris Lien~ 1810 Hayfield Road, property owner of Lot 1, Block 4
Centerville Heights and Howard Bohanon, Builder, were present at
the meeting both appeared to be unwilling to participate in
mediation.
I

Howard Bohanon advised he understood that the correction did not
meet Ms. Nelson's expectations. He advised that he would solve
the sod concern she has and would remove the ridge area.

Council member Wilharber advised that he drove by the lot today
and it appeared to have no standing water. The sod appeared to
be growing, but there were rough areas.

Motion by Burgstahler, second by Dario to appoint Mayor Buckbee
as the Centerville Representative to meet Howard Bohanon and
Debra Nelson regarding the restoration of sod work to be done on
NI. N@llon-. lot and the sod work shall be inspected by Mayor

---.
