<br />Pursuant to due call and notice thereof the City Council of the <br />City of Centerville held a special meeting on September 2, 1992 <br />at the City Hall. The purpose of the special meeting was to <br />discuss Center Hills, Third Addition. Acting Mayor Pelton called <br />the me~ting to 5:40 p.m. Present: Wilharber, Dario. Absent: <br />Buckbee, Burgstahler. <br /> <br />Center Hills. Third Addition <br />John Stewart, City Engineer, <br />Gerald Rehbein, Developer for <br />and Acorn Creek Development. <br /> <br />presented the proposed plan of <br />the Center Hills, Third Addition <br /> <br />Council member Burgstahler arrived at 6:05 p.m. <br /> <br />Gerald Rehbein, Developer for the Center Hills, Third Addition, <br />requested a commitment of the location of the sewer easement so <br />that he could install sewer and possibly water lines to <br />facilitate the Center Hills, Third Addition. <br /> <br />It was noted that a change order to facilitate the construction <br />can not exceed 25% of the original cost estimates. <br /> <br />Motion by Burgstahler, second by Dario to lift the suspension of <br />building permits on the Center Hills, Third Addition, contingent <br />upon: <br />each permittee signing a letter agreeing that the <br />premise shall not be occupied and that there shall be <br />no transfer of ownership of the property and that the <br />building will not be use for habitation until such time <br />that a satisfactory resolution for the discharge of <br />sanitary sewer has been determined; <br />the permittee shall also agree that the permit for the <br />building construction is issued at the risk of the <br />permittee and that the City of Centerville shall incur <br />no liability should the satisfactory solution not be <br />determined for the discharge of municipal sewerage in <br />the Center Hills, Third Addition; <br />the City of Centerville shall advise in writing to the <br />permittee when sewer service will be available to the <br />building, <br />motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Dario that the City has approved <br />the concept alignment for the proposed municipal sewer and water <br />extension through the proposed Acorn Creek Development to <br />facilitate the Center Hills, Third Addition development; <br />Ro-So Contracting, Inc., and the City Attorney shall be <br />consulted to see whether a change order for the <br />improvement can be facilitated; <br />to order plans and specifications for the improvement <br />of the extension of the municipal sewer and water <br />oontln'8nt upon r.o81pt of .
