City Council Meeting Minutes
December 21, 1992
page two

minutes he feels that, based on the four criteria as outlined in
the City Ordinance, it would be difficult for the City Council to
find reason to allow this oversized garage.

Council member Dario stated that a smaller garage could hold all
three cars and that he feels a garage that is 624 square feet is
large enough.

Council member Pelton indicated that she would be more willing to
go along with an attached garage that forms a "L" shape which
would meet the Ordinance requirements. She further stated that
she feels that this variance does not meet the four criteria.

Mr. Curtis Burn, 7169 West Robin Lane, appeared before the
Council and stated he built the house in the present location
with the intention of building a detached garage. Mr. Burn
further stated there are no complaints in the area concerning the
construction of this over sized garage and in fact has letters of
reconmlendation from immediate neighbors. Mr. Burn stated he felt
the Planning and Zoning Commission should have voted on this
variance earlier and sent its recommendations to the City
Council.

Council member Pelton explained that the Planning and Zoning
Commission was not able to vote on this variance since there was
an error by the Quad Newspaper in the legal notice.

Mr. Curtis Burn stated that almost everyone in the neighborhood
has a garage and that not many more garages will be built in the
area.

Council member Dario requested what time schedule Mr. Burn has
for constructing this garage since it is now the winter season.

Mr. Burn stated that he intends to begin construction of the
garage next spring.

Council member Burgstahler stated that, based on the facts before
him, he does not see a reason for granting this variance.

Council member Pelton reiterated that this over sized garage must
meet the four standards for granting a variance as outlined in
Ordinance #4. Council member Pelton further stated that in new
developments it is required by City Ordinance that all
residential dwelling have attached garages.

Council member Burgstahler indicated the City did grant a
variance to one lot that was adjacent to a conservation area.
