<br />City Council Meeting Minutes <br />August 26, 1992 <br />page four <br /> <br />water actually stands in the yard. He noted that from a site <br />visit the water does appear to drain, but if the slope was <br />steeper the water would drain quicker. He advised that it <br />appears the problem began when Harstad (the previous property <br />owner) stripped Centerville Heights and left dirt on the back of <br />the Lein property presenting problems to the Nelson's property. <br />He also noted that the grading on the Lein property does not <br />agree with the Centerville Heights grading plan. He noted that <br />it does appear the Lein property is impounding more water on the <br />Nelson property than was originally held. <br /> <br />Mayor Buckbee noted that Mr. Bohanon has been sent a letter by <br />the City of Centerville recommending mediation. <br /> <br />Mr. Jensen advised that he would like the City of Centerville to <br />refund the escrow monies to Mr. Bohanon while mediation is taking <br />place between the two property owners leaving the discussion to <br />be a neighbor issue. <br /> <br />Council member Wilharber noted that the individual neighbors are <br />the City and Mr. Bohanon signed an agreement with the City to <br />correct the grading. He advised he thought mediation would be <br />the best way to go. He expressed concern and that although he is <br />hearing from Mr. Bohanon and the Lein's he is not hearing from <br />the Nelsons. <br /> <br />Mr. Bohanon advised that he signed an agreement with the City <br />because the Lein's needed a place to live. <br /> <br />Motion by Burgstahler, second by Wilharber to table this issue <br />until the September 9, 1992 City Council meeting and that City <br />Staff shall advise Ms. Nelson of this item being placed on the <br />City Council Agenda, motion carried unanimously. <br /> <br />Mound Trail <br />Motion by Wilharber, second by Burgstahler to receive the Plans <br />and Specifications for Mound Trail Patching and Overlay prepared <br />by Maier, Stewart and Associates and that bids shall be ordered <br />to be opened on September 9, 1992 contingent upon proper notice <br />being submitted into the Quad Press in time for said bid opening, <br />motion carried unanimously. <br /> <br />Water Connection/Well to Municioal Facilitv <br />Motion by Burgstahler, second by Wilharber to direct the City <br />Engineer to negotiate a change order with Ro-So Contracting to <br />add on site piping to connect the well to the municipal facility <br />as per the Engineering Plans submitted by Maier, Stewart and <br />ASlociatel to be added onto the Center Hills Third Addition/Main <br />Street Water Extension bid for a dollar amount of $10,500.00; <br />
