<br />City Council Meeting Minutes <br />August 26, 1992 <br />page five <br /> <br />the Engineering Liaisons shall have the authority to approve the <br />negotiated agreement between the City Engineer and Ro-So <br />Contracting, motion carried unanimously. <br /> <br />A copy of a letter dated August 26, 1992 regarding "Water <br />Connection: Well to City Hall/City Hall to Main Street Extension" <br />presented by the City Engineer with a site plan showing the <br />connection is file with the Clerk/Administrator. <br /> <br />Municipal Buildin~ <br />It appeared to be the consensus of the City Council to have City <br />Staff negotiate with the Dennis Zerwas the video taping of the <br />construction of the municipal facility from start to finish. <br /> <br />Peltier Lake Drive Culvert Reconstruction <br />The City Council reviewed a letter dated July 28, 1992 <br />Rice Creek Watershed District in response to the City's <br />for improvement of the Peltier Lake Drive Culvert. <br /> <br />from the <br />questions <br /> <br />The City Engineer summarized that it appeared that the Rice Creek <br />Watershed District would review the project, but not require a <br />petition. It was noted that the project could be funded with Tax <br />Increment Financing and/or the Flood Reduction bond money. <br /> <br />Council member Burgstahler expressed concern regarding the <br />project. He advised that he hated spending money for something <br />that could have no value to the City. He noted that the culvert <br />has been working fine for ten years and doesn't understand why it <br />needs to be ripped out now. He noted that the Department of <br />Natural Resources has said that the City must fix it, but would <br />like to know what would happen if the City were to refuse. What <br />would be the consequences such as stopping the Clear Water Creek <br />Flood Reduction Project. He noted that up stream impact does not <br />appear to be great. He would like an analysis in writing from <br />the City Attorney advising of the possible consequences of not <br />completing the improvement other than the stopping of the <br />Clearwater Creek Flood Reduction project. <br /> <br />Motion by Burgstahler, second by Buckbee to direct the City <br />Attorney to review the consequences of not reconstructing the <br />Peltier Lake Drive culvert as requested by the Department of <br />Natural Resources; <br />the Clerk/Administrator shall discuss the issue with <br />the City Attorney prior to his beginning the review and <br />the City Attorney shall complete a written opinion if <br />it is not cost prohibited; <br />it is understood that the review could include <br />conversations with the Department of Natural Resources, <br />the City Engineer, etc., <br />motion carried unanimously. <br />
