<br />City Council Meeting Minutes <br />August 26, 1992 <br />page seven <br /> <br />Motion by Burgstahler, second by Buckbee to instruct the City <br />Attorney to advise as to whether the City of Centerville can <br />discontinue issuing building permits on the Center Hills Third <br />Addition until the issues have been resolved; <br />the City Staff shall advise the developer that it <br />appears that all issues need to be addressed and put <br />into a time frame with a regard to an interim sewer <br />plan for the Center Hills Third Addition; <br />when the developer reproaches the City Council with an <br />acceptable interim sewer plan the City shall begin <br />reissuing building permit on the Center Hills Third <br />Addition, <br />motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Buckbee to authorize and request <br />the following work to be completed by the City Engineer and <br />appropriate escrows to be deposited by the developer prior to <br />work being initiated by the City Engineer: <br />Acorn Creek grading plan, appropriate escrow $4,900.00; <br />Feasibility Study, appropriate escrow $1,500.00; <br />Rice Creek Watershed District Permit Application, <br />appropriate escrow $1,500.00, <br />motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Buckbee to direct the <br />Clerk/Administrator to advise the City Attorney of the process <br />and the steps being taken regarding the Center Hills Third <br />Addition and Acorn Creek developments and request his opinion as <br />to whether he is comfortable that the City is not creating <br />further liability, motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Wilharber to order the City <br />Engineer to stop work on the extension of municipal sewer and <br />water across the proposed Acorn Creek development to the <br />facilitate the Center Hills Third Addition development until a <br />Feasibility Study and a grading plan have been approved, motion <br />carried unanimously. <br /> <br />Mr. Stewart advised that if the City were not to complete the <br />Plans and Specifications for the water and sewer main across the <br />proposed Acorn Creek development that it would be to late in the <br />year to construct the sewer lines on Mill Road and replace the <br />black top in time for winter. <br /> <br />Council member Wilharber noted that two City Engineers were at <br />the August 12, 1992 City Council meeting and expressed concern <br />that the issues in the August 26, 1992 letter regarding <br />"Engineering Issues: Center Hills Three/Acorn Creek" were not <br />presented. <br />
