Motion was seconded by <br />Council member Dario and upon vote, unanimously approved. <br /> <br />Due to the four conditions not being met and based upon the <br />history of this case, a motion was made by Council member <br />Burgstahler to allow City staff to refund the $150.00 variance <br />fee to Curtis Burn. Motion was seconded by Council member <br />Wilharber and upon vote, unanimously approved. <br /> <br />Motion was made by Council member Burgstahler to red tag the <br />construction of the accessory building on 7181 West Robin Lane <br />and any other accessory building that is under construction which <br />exceeds the zoning requirements. The motion was seconded by <br />Council member Wilharber and upon vote unanimously approved. <br /> <br />Council member Burgstahler directed staff to notify Curtis Burn <br />when the Planning and Zoning Commission will be considering the <br />ordinance amendment. <br /> <br />Council member Wilharber requested that the staff do a survey of <br />how many homes in the district that do not have garages at this <br />time. <br /> <br />3. THE MILL ROAD SIDEWALK AND STORM SEWER - COST ESTIMATES. <br /> <br />Council member Burgstahler indicated that Tax Increment Financing <br />could be used for this project since it would be difficult to <br />assess the project to adjacent property owners. <br /> <br />Council meInber Pelton indicated that, if the side walk was built <br />eight feet wide, the Centennial School District could be <br />interested in providing matching funds for this project. <br /> <br />Council member Burgstahler indicated that the City Council should <br />take a look at the entire Tax Increment Financing situation for <br />the City. <br /> <br />Motion was made by Council member Burgstahler to accept the <br />Engineer~s report. The motion was seconded by Council member <br />Wilharber and, upon vote, unanimously approved. <br /> <br />4. WYNE DRAINAGE ISSUE AND DRIVEWAY REPAIR. <br /> <br />Clerk/Administrator Siebenaler explained to the City Council that <br />City Engineer, John Stewart, Al Mjorud, Architect for the new <br />City Hall construction, and Gilbert Construction have discussed <br />
