<br />City Council Meeting Minutes <br />July 8. 1992 <br />page three <br /> <br />~im Stevens Construction - ReQuest for S~ecial Use Permit - Place <br />Fill in Flood Plain <br />John Stewart, City Engineer, was present and presented and a <br />letter dated July B, 1992 regarding ditch and driveway permit <br />CR53 Stevens Property. Mr. Stewart advised that it appears that <br />the driveway overlays the concrete culvert which flows from the <br />Ken Carpenter property on the west side of County Road 53. He <br />noted that this is one of the culverts which is included in <br />Centerville's Flood Reduction Project, thus any ditching or <br />driveway work required of the Steven's would be destroyed if the <br />City project were to proceed. He also noted that the driveway <br />tips so that the surface drainage is northward into the ditch and <br />this combined with the culvert flow is eroding the ditch slopes <br />and culvert coverage. Mr. Stewart suggested that the Steven's <br />submit an escrow of $1,500.00 for a two year period. If the <br />Flood Reduction Project were to proceed within this time frame <br />the Steven's escrow would be returned. If the erosion were to <br />become intolerable or the Flood Project be cancelled then the <br />Steven's would be instructed to undertake the necessary repairs <br />prior to the release of the $1,500.00 escrow. <br /> <br />A copy of the letter dated July 6, 1992 prepared by John Stewart, <br />Maier, Stewart and Associates is on file with the <br />Clerk/Administrator. <br /> <br />Motion by Pelton, second by Bursstahler to approve the requested <br />Conditional Use Permit of the Jim Stevens Construction to place <br />fill within the flood plain area on the Steven's property east of <br />County Road 53 (20th Avenue) contingent upon the following: <br />removal of the stored sand, gravel and dirt on the Jim <br />Steven's property on the west side of 20th Avenue <br />abutting Clearwater Creek within 30 days; <br />that a silt fence be installed around the sand, dirt <br />and gravel to be removed, prior to and during the <br />removal, to enhance an erosion control and minimize <br />sediment into Clearwater Creek; <br />to seed the location were the sand, dirt and gravel is <br />removed on the west side of 20th Avenue on the Steven's <br />property abutting Clearwater Creek; <br />a copy of the Rice Creek Watershed Permit obtained by <br />Stevens for the project driveway/fill be submitted to <br />the City Hall; <br />$1,500.00 in escrow be submitted by the Jim Steven's <br />Construction to be held with the City of Centerville <br />for two (2) years, if the Flood Reduction Project were <br />to proceed within this time frame the Steven's escrow <br />would be returned, if the erosion were to become <br />intolerable or the Flood Projeot to be oanoelled the <br />
