The City has until June 30, 1992 to accept the bid. <br />It appeared to be the consensus of the City Council to wait until <br />a future a City Council meeting to award the bid for the second <br />municipal well. <br /> <br />Center Hills Second Addition - Development A~reement <br />Motion by Burgstahler, second by Pelton to amend the Development <br />Agreement between the City of Centerville and R&R Leasing to <br />allow occupancy permits prior to the second lift of bituminous <br />being placed on streets per the recommendation of the City <br />Engineer; property owners shall be notified prior to closing of <br />a possible 3 - 5 hour delayin accessing or leaving their homes <br />when the second lift of bituminous is placed on the streets, <br />motion carried unanimously. <br /> <br />Clear Water Creek Flood Reduction Proiect <br />The City Council reviewed the letter from the Rice Creek <br />Watershed District dated May 18, 1992, the Department of Natural <br />Resources dated April 23, 1992, Maier, Stewart and Associates <br />dated May 21, 1992, Bruce Malkerson of Popham Haik dated May 14, <br />1992 and Greg Hellings, City Attorney, dated May 20, 1992. The <br />letters referencing the Clear Water Creek Flood Reduction Project <br />and are on file with the Clerk/Administrator. <br /> <br />John Stewart, City Engineer, was present to answer questions <br />regarding the Clear Water Creek Flood Reduction Project. Mr. <br />Stewart noted that Steve Woods, Rice Creek Watershed District <br />Engineer, was contacted and it appears that it was his opinion <br />that Peltier Lake Drive was the overwhelming legal issue that <br />initiated the May 18, 1992 letter suggesting the current <br />petitions be withdrawn and new petitions submitted. <br /> <br />Council member Burgstahler noted that the Peltier Lake Drive <br />culvert was installed approximately ten years ago. Now the <br />Department of Natural Resources requests a decision by the City <br />of Centerville on how to obtain easements upstream of the culvert <br />by May 30, 1992. Council member Burgstahler was not clear on <br />what was the urgency in the matter and was not convinced of the <br />problems with the current culvert size. Council member <br />Burgstahler noted frustration and felt that the City was going <br />around in circles when dealing with the Rice Creek Watershed <br />District and that the Rice Creek Watershed District was a <br />
