<br />City Council Meeting Minutes <br />May 13, 1992 <br />Page nine <br /> <br />Motion by Buckbee, second by Wilharber to approve the Special Use <br />Permit for Bob Sorg for a Noble Welding building on Lot 8, Block <br />1, Centerville Industrial Park for the submitted site plan <br />contingent upon the following: <br />necessary approval from the <br />District; <br />the developer shall <br />paving in the parking <br />nine (9) months after <br />of 21st Avenue; <br />the developer shall agree to modifications of the <br />Special Use Permit to include future paving <br />specifications and the inclusion of an assessment <br />clause that shall be utilized should the property owner <br />not constructed the paving area within nine (9) months <br />after completion of 21st Avenue; <br />and the City Staff, City Attorney and City Engineer <br />shall work cooperatively to develop an acceptable <br />Special Use Permit at which the Mayor Buckbee shall <br />have final approval, <br />motion carried unanimously. <br /> <br />Rice <br /> <br />Creek <br /> <br />Watershed <br /> <br />agree to complete the bituminous <br />and driving lanes no later than <br />the completion of the improvement <br /> <br />Waterworks Bar - 3.2 Beer Permit Reauest <br />Rich DeFoe, owner of Waterworks Bar, was present to request a 3.2 <br />Beer Permit on the Waterworks ball fields. <br /> <br />The Centerville Ordinance #11 provides for the issuance of a <br />Temporary Non-Intoxicating Malt Liquor License containing not <br />more than 3.2 alcohol by weight shall be issued for a limited <br />period of time not to exceed three days. It was also noted that <br />the cost for the issuance of a license is a $200 deposit and a <br />license fee of $35.00 for the first day and $5.00 for each <br />additional day the license is to be effective. <br /> <br />Mr. DeFoe noted for each three day period he would be charged <br />$45.00 and he thought that this may be excessive as the City only <br />processes the permit one time. Mr. DeFoe requests consecutive <br />3.2 Beer Licenses from May 14, 1992 through approximately the <br />beginning of October. Mr. DeFoe noted that there is a fenced in <br />beer garden area and that persons selling the beer will be <br />responsible for the control of the persons consuming the alcohol. <br />He noted that generally that there would 20-30 people being <br />served and he also noted at this time he has no one posted at the <br />gate of the fenced in area. Mr. DeFoe advised that he would <br />proposed serving the 3.2 beer from 6:15 p.m. until 10:30 p.m. <br />Mr. DeFoe appeared to feel that through his conversation with the <br />Minnesota Liquor Control Division that it may be feasible for him <br />to pursue the sale of hard liquor on the ball fields versus <br />obtaining a consecutive 3.2 Beer Permits through the summer.
