<br />City Council Meeting Minutes <br />May 13, 1992 <br />Page ten <br /> <br />suggested a 3.2 Beer Permit for 30 days while he pursues the <br />possibility of obtaining a permanent license for the area. <br /> <br />The Clerk/Administrator noted that the City Attorney in a letter <br />dated May 14, 1992 regarding 3.2 Beer Licenses for the Waterworks <br />appeared to be of a different opinion. The City Attorney <br />appeared to feel that Minnesota State Statue 34A.403, Subdivision <br />3 dealing with non-intoxicating malt liquor licenses does not <br />appear to apply Mr. DeFoe's present situation since the ball <br />fields are not included within the premises of the Waterworks <br />Liquor License. The City Attorney did also advised in the letter <br />that if Mr. DeFoe were to obtained an written opinion to the <br />contrary from the Minnesota Liquor Control Board that he would <br />re-examine the matter. A copy of the May 14, 1992 letter is on <br />file with the Clerk/Administrator. <br /> <br />Mayor Buckbee noted concern regarding possible police calls to <br />the field. He advised that the cost incurred to the City for the <br />police calls and attorney's fees may not be un-proportionate to <br />the $45.00 for each three day period being proposed. <br /> <br />Council member Dario expressed concern regarding policing the <br />parking lot areas. <br /> <br />Council member Pelton suggested that the licenses be issued for <br />shorter periods of time and the licenses could be placed on the <br />City Council consent agendas if no problems are arising from the <br />sale of the 3.2 beer. She also suggested that Mr. DeFoe use <br />paper cups versus plastic with regard to recycling. She also <br />noted that Mr. DeFoe should contact the Circle Pines/Lexington <br />Police Department to make sure that they are aware that he has <br />obtaining the Temporary 3.2 Beer Permit/Licenses. <br /> <br />Council member Wilharber advised that he had a concern regarding <br />the control of the alcohol consumption and where it would take <br />place. He noted that the current City Noise Ordinance reflects a <br />cut off time of 1(1:00 p.m. and that this 10:00 p.m. deadline is <br />also referred to in Ordinance #11 authorizing issuance of <br />Temporary Non-Intoxicating Malt Liquor Licenses. Mr. Wilharber <br />noted that the Ordinance #11 appears to address temporary <br />issuance of 3.2 beer permits which shall be no more than three <br />days in length. He is concerned that having a license from May <br />through September is a long time and may not be a good idea to <br />issue such a long term license permit. <br /> <br />The Clerk/Administrator shall double check with the City Attorney <br />regarding the legality of issuing consecutive three day 3.2 beer <br />permits. <br />
