<br />CITY COUNCIL MEETING MINUTES <br />DECEMBER 9, 1992 <br />PAGE FOUR <br /> <br />Motion was made by Council member Wilharber, second by Dario to <br />direct the staff and the Mayor to offer a refundable earnest <br />money contract to the property owner of Lot 6~ Block 1 L~Allier <br />Estates in the amount of $350.00 with a contingency that purchase <br />be made within 120 days and that the staff and Mayor could <br />negotiate the purchase price; and that the City Engineer develop <br />cost estimates for the Mill Road walkway from Peltier Lake Drive <br />to Main Street. <br /> <br />Upon further discussion Mayor Buckbee recommended that the motion <br />be rescinded. <br /> <br />Council members Wilharber and Dario rescinded their motion. <br /> <br />Motion by Council member Pelton~ second by Dario to authorize the <br />Mayor and the staff to make an offer to negotiate a purchase <br />price and enter into a 120 day earnest money contract for the <br />purchase of Lot 6~ Block 1 L#Allier Estates; and to direct the <br />City Engineer to prepare a scope of services letter for <br />construction of a walkway on Mill Road from Peltier Lake Drive to <br />Main Street. Upon vote the motion was unanimously approved. <br /> <br />ADDITIONAL ITEM lB. WELL NUMBER TWO AND REQUEST FOR EXTENSION OF <br />COMPLETION DATE. <br /> <br />City Engineer Stewart indicated that the contractor for the water <br />controls is having difficulty in receiving the necessary <br />equipment within the prescribed 60 day delivery date. The <br />contractor has requested an extension of the completion date from <br />60 days to 120 days, with completion on April 2, 1993. The <br />contract penalty would be imposed after that date. <br /> <br />Mayor Buckbee requested clarification as to what would happen if <br />our current well would go out during that extended 60 day period. <br /> <br />Mr. Stewart indicated that he would recommend that the City <br />Council hold the contractor responsible to pay for the repair <br />costs if the current well goes out during that time. City <br />Engineer Stewart requested action by the City Council to extend <br />the contract period to 120 days, providing the contractor pays <br />the labor for repair of the existing well if it goes out during <br />the 60 day extension period and pays the costs of engineering for <br />the change orders. <br /> <br />Motion by Mayor Buckbee to direct staff to develop a Change Order <br />for municipal well #2 and that the E.H. Renner & Sons, Inc. be <br />allowed a 60 day extension period; contingent upon E.H. Renner & <br />
