<br />CITY COUNCIL MEETING MINUTES <br />DECEMBER 9, 1992 <br />PAGE SEVEN <br /> <br />license fees to be comparable to the amount of cost that the City <br />incurs for administration and police services for these <br />establishments. Mayor Buckbee further stated that he felt using <br />a square foot formula for establishing the fee was the most <br />equitable method devised. He further recommended that the City <br />adopt the second option which calculates the number of square <br />feet for the interior plus half of the square feet for any <br />exterior area which is used for the licensed area. The license <br />fee is then calculated by multiplying the total square footage by <br />$.62 to arrive at the license fee requirement. In this case, the <br />required fee for the Waterworks would be $4,000.00; Kelly~s <br />Korner $2,500.00; and the Trio Inn $2,500.00. Mayor Buckbee <br />then opened the meeting for comment from the public. <br /> <br />Mr. Paul Montain, 7082 Centerville Road, appeared before the <br />Council and stated that he saw no problem with the increase in <br />fee for his business, Trio Inn, except for the fact that he has <br />only thirty days to come up with the additional fee. Mr. Montain <br />further requested that the City Council entertain the possibility <br />of removing the requirement of the liquor license holders to <br />provide a $3,000.00 off-sale surety bond and a $5,000.00 on-sale <br />surety bond. Mr. Montain stated that these surety bonds are no <br />longer required by the Minnesota Liquor Control Commission and is <br />required only by local ordinance. <br /> <br />Mr. Rich DeFoe, 7281 Main Street, of the Waterworks appeared <br />before the Council and stated that the City Council should give <br />consideration to the fact that the other cities used by <br />Centerville to compare license fees have a much larger population <br />base than Centerville. Mr. DeFoe also stated that since his <br />license fee is being increased from $2,000.00 per year to <br />$4,000.00 per year that the short notice of increase will <br />constitute a hardship on him in paying the fee by January 1, <br />1993. <br /> <br />Mr. Bill Bisek, 7087 Centerville Road, owner of the Kelly~s <br />Korner appeared before the Council and stated that the short <br />notice of the fee increase is a hardship since he will only have <br />two weeks to come up with the increased payment. Mr. Bisek also <br />requested that the surety bond requirement be removed from the <br />City ordinance. <br /> <br />Clerk/Administrator Siebenaler explained that the surety bond has <br />been required in the past to provide a means for a municipality <br />to recoup the cost of litigation in the case of a revocation of a <br />liquor license.
