<br />CITY COUNCIL MEETING MINUTES <br />DECEMBER 9, 1992 <br />PAGE EIGHT <br /> <br />license, there is seldom if ever an occasion that the City would <br />need to take a liquor establishment into a court proceeding. Mr. <br />Siebenaler therefore advised the Council that the surety bond is <br />of limited valve. <br /> <br />Council member Pelton stated that the dollar amount of the <br />license fee is tied directly to the increase costs of police <br />services necessary for this type of business. Council member <br />Pelton further stated that the City staff did a survey of <br />neighboring cities and found these fees to be comparable. She <br />further stated that the City could allow an extension for the <br />payment of the additional fee and we could consider reducing the <br />cost per square foot from $.62 per square foot to $.60 per square <br />foot. <br /> <br />Council member Wilharber stated that, during his tenure as <br />Council member for the City of Centerville, he has never known <br />the City to exercise its right of a surety bond and recommends <br />that the City drop the bond requirement. He further recommended <br />that the City extend the payment of the additional fee for four <br />months to May 1, 1993. <br /> <br />Mayor Buckbee summarized three issues that he feels are before <br />the Council as follows: <br />1. Timing of the license fee change. <br />2. The value of the license. <br />3. The additional expense of police services. <br />Mayor Buckbee further stated that the largest budget item for the <br />City is to provide 'police protection. <br /> <br />Motion by Council member Pelton that the 1993 On-Sale Liquor <br />License Fees be set at a minimum of $2,500.0 and a maximum of <br />$4,000.00. That the On-Sale fee shall be calculated on the <br />interior square footage at $.60 per square foot and the exterior <br />square footage be calculated at $.30 per square foot. Council <br />person Pelton further moved that $2,000.00 of the On Sale Liquor <br />License Fee shall be due and payable prior to December 31, 1992 <br />and the balance would be due and payable by May 1, 1993. If full <br />payment is not received by May 1, 1993 the liquor license would <br />be revoked. The motion was seconded by Tom Wilharber and <br />approved upon vote as follows: AYE - Mayor Buckbee, Council <br />member Wilharber and Council member Pelton. NAY - Council member <br />Dario. <br /> <br />Motion by Council member Pelton to waive the surety bond <br />contingent upon concurrence by the City Attorney, motion was <br />seconded by Tom Wilharber and upon vote unanimously approved. <br /> <br />6F.
