<br />Meeting Minutes <br />page six <br />September 14, 1988 <br /> <br />section of Westview Street that is to be vacated, motion carried <br />unanimously. <br /> <br />Motion by Neumann, second by Fritchie to table discussion of the <br />portable pump to be purchased by the Public Works Department for <br />use with the municipal sewer system, until such time that the <br />City Engineer and the Public Works Director can discuss the <br />matter, motion carried unanimously. <br /> <br />Motion by Neumann, second by Burgstahler to adopt Resolution #88- <br />52 to declare Keith and Diane Harstad, developers for the <br />Centerville Heights residential development in default of their <br />Development Agreement with the City of Centerville with regard to <br />the completion date of the improvements on said development; the <br />City Clerk is directed to draw on the letter of credit in the <br />amount recommended by the City Engineer in a letter dated <br />September 14, 1988; the dollar amount for the letter of credit <br />will be placed in a separate interest bearing City account; Clerk <br />is directed to write a letter to Keith and Diane Harstad <br />informing them of the draw on the letter of credit and that it <br />will take the City two weeks to hire contractors to complete the <br />project, during this time period Harstad may continue work on the <br />project; any monies not used by the City to install the remaining <br />municipal improvements, less administration, engineering and <br />legal costs, will be returned to Harstad, motion carried <br />unanimously. <br /> <br />A copy of the September 14, 1988 City Engineer letter is on file <br />with the City Clerk. <br /> <br />Motion by Burgstahler, second by Neumann to adopt resolution #88- <br />53 to accept the preliminary plat of the property described as: <br />the south 10 acres of the west 1/2 of the northeast quarter <br />of the northeast quarter, section 23, township 31, range 22, <br />Anoka County, Minnesota, also referred to as the proposed <br />Hardwood Pond Estates residential development, <br />as recommended by the Planning and Zoning Commission, contingent <br />upon: <br />-submission of all items addressed in Ordinance #8, Article <br />4, Section, 43 - Preliminary Plat, 43.02. SITE MAP. <br />(43.02-1, 43.02-2, 43.02-3, 43.02-4, 43.02-5, 43.02-6, <br />43.02-7, 43.02-8, 43.02-9), 43.03. SUBDIVISION PLAT <br />(43.03-5) and 43.03-5 ENGINEERING PLANS (43.04-1, <br />43.04-2, 43.04-3); <br />-that all lots have at least 80 feet of frontage; <br />-that the revised preliminary plat show a 66 foot road; <br />-developer providing written documentation or support where <br />the foundry sand stored on the proposed development <br />came from and the type, and the City Clerk receives <br />support from the proper authorities that the foundry <br />
