<br />CC Meeting Minutes <br />page seven <br />September 14, 1988 <br /> <br />sand stored on the sight is not considered dangerous; <br />-that a permanent and complete City easement be granted to <br />the City for Fox Run, Brian Drive, and Brian Way <br />throughout the plat; <br />-that adequate waivers and release of liability to the City <br />are received from the developer with regard to any <br />costs that may be incurred associated with rezoning, <br />regulations or policies which are not compatible with <br />the area outside the existing Metropolitan Urban <br />Service Area (MUSA) boundary; <br />-that all costs incurred for the development are paid by the <br />developer; <br />-that Metropolitan Council grants the City's rezoning <br />request for the area; <br />motion carried unanimously. <br /> <br />A copy of the proposed Hardwood Pond Estates preliminary plat is <br />on file with the City Clerk. <br /> <br />Discussion on City policy for collector streets and sidewalks. <br />City Council and developers present did not agree on what the <br />City policy should be. City Clerk will research what other <br />cities policies are. <br /> <br />Motion by Burgstahler, second by Neumann that per the <br />recommendation of the City Engineer adopt Resolution #88-54 to <br />accept the plans and specifications for sanitary sewer, <br />watermain, storm drainage, and street construction for the <br />proposed Hardwood Pond Estates development, contingent upon: <br />-that an easement in the street right of ways be granted for <br />the north half of the project; <br />-that no building connections will be allowed to sewer <br />and/or water in the north half of the project that is <br />not in the MUSA boundary; <br />-that the appropriate Rice Creek Watershed Permit be <br />documented in the City Office for the project; <br />-that the provision of the east half of Fox Run be resolved <br />(possible escrow from the developer); <br />-that the issue of if there should be a sidewalk along the <br />collector street and who should pay for it, also who <br />should pay for the over sizing of the collector street <br />be resolved; <br />-that an acceptable development agreement be obtained; <br />motion carried unanimously. <br /> <br />A copy of the preliminary Hardwood Pond Estates plans and <br />specifications are on file with the City Clerk. <br /> <br />Motion by Burgstahler, second by Fritchie to table discussion of <br />a potential petition for water from Hardwood Pond Estates until <br />
