<br />Meeting Minutes <br />page three <br />December 14, 1988 <br /> <br />incoming Council members, motion carried unanimously. <br /> <br />Dia~uaaion of maintenance bond and lift station easement needed <br />for Center Oaks II. Kent Roessler of Kenco Construction advised <br />that he has been unsuccessful in obtaining the necessary easement <br />for the lift station. Roessler also advised that he did not feel <br />the requirement of a 20% maintenance bond was clearly specified <br />in his development agreement with the City, thus did not feel he <br />was legally obligated to provide one. Roessler expressed concern <br />of the cost of the maintenance bond. Clerk noted that a letter <br />of credit may be less expensive to the developer and would be <br />acceptable to the City in place of a maintenance bond. <br /> <br />Motion by Neumann, second by Fritchie to instruct the City <br />Engineer and Council member Neumann to meet with the property <br />owner at 1889 Center Street to discuss concerns that he may have <br />with regard to an easement for the lift station, with the intent <br />to resolve the matter satisfactorily to all parties; any cost <br />incurred to the City for their involvement will be borne by the <br />Kent Roessler, Kenco Construction, motion carried unanimously. <br /> <br />Motion by Neumann, to turn over the matter of the maintenance <br />bond to the City Attorney; the City Attorney will meet with <br />the Kenco Construction attorney in an attempt to resolve the <br />matter; <br />motion amended and seconded by Wilharber, that should the matter <br />not be resolved, the 1989 contractors license for Kenco <br />Construction will not be renewed in the City of Centerville, <br />effective January 1, 1989, motion carried unanimously. <br /> <br />City Clerk noted that Parent <br />requirements discussed at <br />meeting. <br /> <br />Construction <br />the November <br /> <br />has complied to all <br />21, 1988 City Council <br /> <br />John Stewart, City Engineer noted that the water system appears <br />to be up and operating normally. <br /> <br />Des Englund, 7081 Brian Drive, noted that the blacktop on Brian <br />Drive in Hardwood Ponds appears to be higher than the curb. In <br />response, it was noted that Brian Drive has been accepted by the <br />City, and that if there were problems on the street it would have <br />to be taken care of by the developer. The developer has a one <br />year maintenance bond with the City. <br /> <br />Carol Pelton, Park and Recreation Committee Chairperson advised <br />that it is probable that the additional $3,000 in grant monies <br />for the skating rinks will be received by December 29, 1988. She <br />also noted that the heating contractor has begun work on the <br />building and that skating is expected to be open beginning <br />January 1, 1989. <br />
