This should be reflected <br />throughout the Development Agreement. <br />-Developer's Agreement, page 4, #3.c.1., "except sidewalks <br />shall be completed not later than August 15, 1989." <br />-Developer's Agreement, page 6, #3.c.8., no earthen berm <br />will be required along Main Street due to the water <br />easement required by the Rice Creek Watershed. No berm <br />will be required along the commercial properties. The <br />City will require a tree berm along the back of lot 14, <br />block 2, which abuts Main Street. The trees will be 18 <br />- 24 inches tall if evergreens and 1" to 1 1/2" if <br />deciduous trees. The type, number, and spacing of the <br />trees will be determined per the recommendation of the <br />State Forester. <br />-Developer's Agreement, page 8, #3.c.10., ".. .the Developer <br />plant more than thirty (30%) percent of the same type <br />of tree." And "All trees, and grass shall be warranted <br />to be alive, of good quality and disease free for a <br />period of twelve (12) months after planting. Sod shall <br />be warranted to be alive, of good quality and disease <br />free for a period of thirty (30) days." <br />-Developer's Agreement, page 9, #3.c.l0., ".. .and adequate <br />drainage on temporary streets." <br />-Developer's Agreement, page 11, #4., "The total estimated <br />cost of such Improvements serving Hardwood Pond Estates <br />is: 29 lots X $1,300 = $37,700. <br />-A stipulation for a maintenance bond be included, which <br />requires the developer to hold a bond or letter of <br />credit with the City in the amount of fifteen (15%) per <br />cent of the original improvement cost during the <br />warranty period (one year after the streets, utilities, <br />etc. have been approved).; <br />motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Neumann to amend the motion in <br />
