<br />CC Meeting Minutes <br />Page seven <br />October 12, 1988 <br /> <br />Works Director, <br />motion carried. <br /> <br />OLD BUSINESS <br />Discussion of Center Oaks II. City Engineer, John Stewart, <br />presented a letter dated October 12, 1988 which outlines 13 items <br />left to be completed on the development before final acceptance <br />by the City. A copy of this letter is on file with the City <br />Clerk. <br /> <br />Motion by Burgstahler, second by Neumann to allow Kenco <br />Construction two weeks to finalize the 13 remaining items which <br />require completion; Clerk is directed to forward a letter to <br />Kenco Construction advising of this and that if not completed by <br />October 27, 1988, the City will draw the security deposited by <br />Kenco Construction for said improvements; administrative costs <br />incurred for the pumps in Lift Station #3 will be added to the <br />list as a 14 item, motion carried unanimously. <br /> <br />Richard Tkaczik, also named on <br />agreement, was present and <br />above motion. <br /> <br />the Center Oaks II development <br />advised that he did understand the <br /> <br />Motion by Burgstahler, second by Neumann to direct the City Clerk <br />to draw on the letter of credit from Parent Construction for the <br />water assessments on the L'Allier Estates II development if said <br />letter of credit is not renewed before the expiration date, <br />motion carried unanimously. <br /> <br />Discussion of the Centerville Heights development. Stewart <br />presented a letter dated October 11, 1988 outlining the items <br />remaining to be completed before final acceptance by the City. <br />He noted that items #1. through #11. were the responsibility of <br />the developer. A copy of this letter is attached to and made a <br />part of these minutes. <br /> <br />Motion by Neumann, second by Fritchie to accept the improvements <br />on the Centerville Heights developments, except for the 11 items <br />as outlined by the City Engineer; the warranty for the 11 <br />remaining items will begin on the date that they are completed; <br />Clerk is directed to write to Harstad Companies to request <br />specific dates of when the remaining 11 items will be completed, <br />motion carried unanimously. <br /> <br />Motion by Burgstahler, second by Neumann to direct the City Clerk <br />to draw on the letter of credits from the Harstad Companies for <br />municipal improvements and water assessments in Centerville <br />Heights if not renewed by the expiration dates; these are two <br />separate letters of credit, motion carried unanimously. <br />
