<br />Right-of-Way <br />The project is likely to require non-significant permanent right of way acquisition, <br />permanent and/or temporary easements, minor changes to access, no <br />relocations, and a low risk of hazardous materials involvement. The project will <br />require approximately: <br /> <br />1.25 acres of permanent trail easements from 17 parcels, <br />and 0.9 acres of temporary easements from 15 parcels, <br /> <br />The project will not require residential or business relocations. <br />The project will not require changes in access. <br /> <br />Hazardous Materials <br /> <br />There is a potential for impacts from contaminated properties along Main Street <br />(CSAH 14). The City has encountered contaminated soils during a previous road <br />reconstruction project on Main Street (CSAH 14). This trail project will have <br />minimal grading and therefore has less potential for encountering contaminated <br />materials. The City is developing a Development Response Action Plan, to be <br />used if any potentially contaminated materials are encountered during <br />construction. The plan ensures that any contaminated soils that are encountered <br />will be handled and treated in accordance with applicable state and federal <br />regulations. <br /> <br />Farmland Protection Policy Act <br />The project will not impact farmland. <br /> <br />Wetland Protection <br />The project may impact 6 wetland basins, with a total impacted area of <br />approximately 16,100 SF or 0.37 Acres. The basins include one type 2 (wet <br />meadow), two type 3 (shallow marsh), one 2/6 (wet meadow and shrub-carr), one <br />2/3 (wet meadow and shallow marsh complex) and one 1/2 (ditched wet <br />meadow). Impacts will be minimized during final design where possible through <br />alignment shifting and tightening of slopes from 4:1 to 3:1. <br /> <br />The wetland encroachment is non-significant. A delineation was performed for <br />wetlands within the project area and has been approved by Rice Creek <br />Watershed. A permit will be submitted later in the design phase of the project <br />when the impacts can be more accurately determined. <br /> <br />The provisions of Executive Order 11990 have been complied with. <br /> <br />A wetland assessment and two-part finding is attached in Appendix C. <br /> <br />Section 404 Of The Clean Water Act <br />The project will involve placement of fill into waters of the U.S. The project will <br />be covered by a Section 404 Permit: <br />
