<br />Council Member Capra asked what illilure to disclose was. Ms. Moore-Sykes explained <br />that a business is required to tell the City that it has had a liquor violation and three of the <br />businesses did not do that when they applied for liquor license renewal. <br /> <br />Ms. Bender indicated that the businesses are also required to disclose the violation to the <br />state. <br /> <br />Council Member Nelson asked which businesses fulled to disclose violations. <br /> <br />Ms. Moore-Sykes indicated that the three businesses were Trio, Kelly's and Sager's <br />Liquors. <br /> <br />Mr. Ken Vanderbeek of7095 20lh Avenue, owner of Wise Guys Pizza, addressed Council <br />and indicated that he had spoken to Mr. Sager who was unaware that he had been charged <br />with a liquor violation. He then explained that Mr. Sager had an employee who was <br />stealing beer and selling it to minors and Mr. Sager found out and reported it to the police <br />who filled out a report and, subsequently, charged him with a liquor violation but did not <br />inform him of that violation. <br /> <br />Council Member Broussard Vickers asked Staff to research whether or not Mr. Sager was <br />notified of the liquor violation before he submitted his application for liquor license <br />renewal. <br /> <br />Council Member Nelson suggested approving all but the three licenses. <br /> <br />Council Member Broussard Vickers asked what the penalty for fuilure to disclose was. <br />Ms. Bender indicated that the City could set the penalty for failure to disclose. <br /> <br />Council Member Travis indicated that the Trio was not found guilty. City Attorney <br />Hoeft indicated that the Trio was found to have a liquor license violation. <br /> <br />Ms. Bender indicated that she had not received an application from Water Works as the <br />application does not need to be turned in until the end of December. <br /> <br />Council Member Broussard Vickers asked if it would be appropriate for the City to <br />establish a penalty fee and order that it be collected prior to issuing the license. City <br />Attorney Hoeft indicated that it would be appropriate for the City to do so. <br /> <br />Mayor Swedberg asked iffuiling to disclose a liquor violation was a common occurrence. <br />City Attorney Hoeft indicated that it does happen and indicated that those businesses not <br />approved at this meeting would not be able to sell after midnight on December 31, 2001. <br /> <br />Motion bv Council Member Broussard Vickers. seconded by Council Member <br />Nelson to establish a fine ol$500.00 Cor Cailure to disclose a liquor violation to the <br />City and request that those businesses that failed to disclose be required to pay the <br />fine 0($500.00 prior to the issuance of their license. <br /> <br />Page 7 of 17 <br />
