The <br />first concern that the Mayor writes about is regarding the number of liquor licenses that <br />the City of Centerville can issue. The City Clerk indicated that she uses information from <br />the Minnesota Department of Public Safety, Chapter 7515, Alcohol Enforcement <br />Division in determining the number of liquor licenses the City could issue. Under <br />7515.0420. LIMITED NUMBER GRANTED. A.. On Sale Retail Liquor Licenses, there <br />is a table that shows fourth-class cities, defined as being under 10,000, to be able to issue <br />7 liquor licenses. Staff contacted Mr. Hoeft, the City Attorney about these State <br />guidelines once the discrepancy was pointed out in the Mayor's memo and he is <br />researching this question. <br /> <br />Mr. Hoeft's letter, which is attached, responds to the Mayor's concern about the <br />possibility of the City having curtailed a licensee's right to due process by the imposition <br />offines at the December 12th Council meeting. Also, the City of Hugo's administrator <br />advised that, they impose the maximum fine of $2000 for any liquor licensing violations. <br /> <br />The Mayor and other members ofthe Council have requested a listing of violations, the <br />results of background checks, etc. from Staff and the Police Department. In speaking <br />with CillefHeckman about the provision ofthese documents, he is reluctant to do so <br />because much of the information he has access to regarding this issue is considered <br />private information. Staff has provided copies of documentation that they have on file <br />and are attached to this memo. <br /> <br />With regards to the City's Fee Structure for 2002, Staff did discuss each fee item. Based <br />on the information that we had at the time, it was determined that the City's intoxicating <br />on-sale liquor license fees were in approximately the same range as other cities of <br />comparable size. In discussing fees with the City Clerk and the Public Works Director, I <br />was not given any indication that they were aware that the Council wished to increase <br />
