<br />" <br /> <br />. <br /> <br />Council Member Capra indicated she did not want to see a sunset clause because it would <br />be too easy to forget and the no wake zone could lapse. <br /> <br />City Attorney Hoeft indicated the two agreements did not need to be identical but should <br />be substantially similar. He then said, in his opinion, the sunset clause is not legal. He <br />further advised Council not to put in the sunset clause because he does not feel it would <br />be valid. <br /> <br />City Attorney Hoeft indicated that Council did not need to make a motion on the matter <br />at this meeting but Lino Lakes is looking for a consensus of Council as to where the no <br />wake line should be. <br /> <br />Council Member Nelson said she feels strongly on keeping the original 400 feet because <br />she thinks the boating is a contributing factor and that would help as suggested by the <br />Department of Parks and Recreation for Anoka County. She then said that she would <br />compromise and go with the 200 feet but disagreed with the sunset clause. <br /> <br />Council Member Travis said he was happy to see that everyone agrees that there should <br />be a no wake zone. He then said he would like to see the Lake Association handle the <br />matter rather than Council. <br /> <br />Council Member Capra indicated the County had made an attempt two years ago to work <br />with thc Association. <br /> <br />Mayor Swcdberg said he was glad to see the efforts to compromise. He then said he did <br />not think it was possible to specify a specific number of feet necessary to protect the <br />birds. He further stated that it may be past the point where the birds will return but he is <br />concerned for water quality and protecting the aquatic plants that help to clean and filter <br />the water. He also stated he is fine with the compromise of 200 feet but does not want <br />the sunset clause based on the advice of City Attorney Hoeft. <br /> <br />City Attorney Hoeft indicated the final wording of the joint powers agreement could be <br />done at a later time. <br /> <br />Council Member Capra asked Ms. Moore-Sykes to contact Ms. Waite-Smith to compare <br />wording. <br /> <br />2. Lift Station # I Renovation <br /> <br />Mr. Peterson indicated the plans for the renovation of Lift Station #1 have been <br />completed and he is asking Council for approval so that the matter can be sent out for <br />bids. <br /> <br />Council Member Capra asked if this would be funded out of the sewer funds and Ms. <br />Moore-Sykes concurred. <br /> <br />Page II of2l <br />
