<br />City of Centerville <br />Council Meeting Minutes <br />April 10, 2002 <br /> <br />Council Member Nelson said the issue of having this concession stand came up when <br />former City Administrator March brought up that the Lions wanted to donate the labor to <br />build the structure and wanted the City to donate the funds to purchase the materials. She <br />also commented that Mr. March had applied for a grant for the concession stand but the <br />grant was not received. She further commented that the Council had never agreed that it <br />wanted to build a concession stand at LaMotte Park and her vote would be not to do so. <br /> <br />Council Member Nelson indicated she was confused at the last meeting and thought that <br />the money was not City money but belonged to the Lions when in reality it is City money <br />for Council to determine how to use. <br /> <br />Mayor Swedberg asked whether the money that is sitting in the City's account was the <br />10% requirement or the 50% requirement. <br /> <br />City Attorney Hoeft indicated the funds represented the 50% requirement. He then <br />clarified that the Spring Lake Park Lions have been giving the City the 10% plus the <br />other 40% that was to be spent in the trade area in order to help the Centerville Lions <br />build the park structure at LaMotte Park. <br /> <br />Council Member Capra indicated the City could spend the funds in any of the lawful <br />ways as listed by the Gambling Control Board. <br /> <br />Council Member Broussard Vickers indicated that the 50lC3 is a lawful use. <br /> <br />City Attorney Hoeft indicated that the City has the ability to give the money to any <br />organization provided the use qualifies as use for a public purpose. He then said, <br />however, the City has a policy of not giving to any organizations because it is difficult to <br />do so fairly. Mr. Hoeft then said he would be more comfortable if the City used the funds <br />to build the pavilion if that is the desire of Council rather than giving the money to the <br />Lions to do so. <br /> <br />Council Member Capra expressed concern with the City donating the funds to the <br />Centerville Lions because it may not be a lawful use of public funds. <br /> <br />Council Member Broussard Vickers commented that the reason the City discussed giving <br />the funds to the 50 I C3 was to get out of the business of housing the funds because the <br />Lions thought the City was holding the funds until enough accumulated to build a <br />pavilion. <br /> <br />City Attorney Hoeft commented that the Lions should have a concern about money <br />sitting in City funds or about giving more money to the City after he had told them that, <br />even if this Council comes to an understanding with them, the next Council may not do <br />so. He then commented that something the executive director of the Gambling Control <br />Board does not state in the newsletter is that once the money is given to the City it is up <br />to Council to determine what that money is used for. He further commented that it is <br />unfortunate in this situation that the Lions had conversations with Staff and the <br /> <br />Page 5 ofl6 <br />
