City of Centerville <br />January 14, 2004 <br />Council Meeting Minutes <br />Council Member Capra asked whether Staff spoke to anyone at the Gambling Control <br />Board concerning accepting donations from the Lions and giving a donation to the Lions. <br /> <br />Ms. Paulseth indicated she had highlighted the applicable areas in the documents <br />provided and commented that the City can do whatever is legally authorized with the <br />funds. <br /> <br />Council Member Capra indicated she would feel better if the Lions would provide a list <br />of what they would spend the money on. <br /> <br />Mayor Sweeney indicated there is a budget for the festival. He then said that the budget <br />is $25,000 and the City has donated $15,000 with specific restrictions as to what it is to <br />be spent on. The other money comes from donations and ticket sales. He further <br />commented that the money that was made last year on the festival was due to food and <br />beer sales during the softball tournament. This year, rather than hitting up the businesses <br />again, the suggestion is to use gambling funds. <br /> <br />Council Member Capra said she is concerned with making a donation because once the <br />City receives a donation it becomes City money and there are restrictions on what can be <br />done with public funds. <br /> <br />City Attorney Hoeft indicated that donating to the Lions is a lawful distribution and, <br />while Council may worry about what it is spent on, it does not restrict the ability to give <br />funds to the Lions. He further commented that the only criteria is that the City donates to <br />the Lions and the Lions are not bound to spend that money according to a public purpose <br />criteria. <br /> <br />Council Member Capra indicated she would be more comfortable with it if the Lions <br />brought her a list of what they would spend the money on so she could make sure it was <br />for a lawful purpose. <br /> <br />Ms. Paulseth commented the festival is a public purpose. <br /> <br />Council Member Capra indicated that beer would not be for a public purpose. <br /> <br />Mayor Sweeney explained that the beer is provided by the distributor and the Lions pay <br />for what they use and they pay for the beer out of the money from the sales. <br /> <br /> 3. Frozen Fete des Lacs <br /> <br />Paul Burke updated Council on the frozen Fete des Lacs. <br /> <br />Council Member Broussard Vickers asked whether the experimental aircraft operators <br />have liability insurance with the City named as an additional insured. <br /> <br />Mr. Burke indicated that the insurance will be in place as will the racing insurance. <br />Page 8 of 10 <br /> <br />
