Car:penter Prooerty <br /> <br />Ms. Moore-Sykes indicated that Mr. Carpenter bad informed the developer he would sell <br />the property for $25,000. She then indicated he bad informed her that he feels this matter <br />is a private matter and he did not want to waste Council time by coming to the meeting. <br /> <br />Council Member Capra indicated she bad contacted Mr. PaIzer with regard to a question <br />on City utilities and he told her that Mr. Rehbein did not pay assessments to put the <br />utilities into that street. <br /> <br />Council Member Travis indicated there was excess assessment off of another job and <br />rather than giving the money back it was applied to the assessments for this project. <br /> <br />Council Member Nelson indicated she did not want to extend this any farther because it <br />has been going on for quite some time. <br /> <br />Council Member Capra indicated she was a little disappointed that Mr. Carpenter did not <br />come to this meeting. She then asked if there was any evidence that the two parties bad <br />spoken. <br /> <br />Ms. Moore-Sykes indicated she spoke with Mr. Rehbein last week and he knows the <br />price. <br /> <br />Mayor Swedberg asked what Council would need to do if it desired to proceed with <br />eminent domain. <br /> <br />City Attorney Hoeft indicated Staff would need to draft a Resolution for Council <br />approval to begin the eminent domain proceeding. He then said the City would need to <br />have an agreement between the City and Royal Oaks as to how the costs associated with <br />this process will be paid. <br /> <br />Council Member Capra asked who determines the price of the land. <br /> <br />City Attorney Hoeft indicated that three individuals appointed by the District Court <br />would decide. <br /> <br />Council Member Capra asked if these individuals would do fair market value or below. <br /> <br />Page 6 of23 <br />
