<br />City ofConterville <br />Council Meeting Minutes <br />June 12,2002 <br /> <br />City Attorney Hoeft indicated the individuals are usually fairly conservative. He then <br />said that the price estimate would likely be only a couple thousand dollars and the real <br />costs would be the attorney's fees to get the City through the process. <br /> <br />City Attorney Hoeft indicated it may cost approximately $10,000 and that is half of what <br />the property owner has requested for payment. <br /> <br />Motion by Council Member Travis. seconded bv Council Member Nelson to direct <br />Staff to prepare a resolution for eminent domain and to notify Mr. Carpenter that <br />the City is proceedine:. <br /> <br />Council Member Capra said she would hope the parties would come to agreement before <br />this goes all the way. <br /> <br />Council Member Broussard Vickers indicated she has mixed emotions on this matter <br />because she sees the matter from both sides. She then said the City has money invested <br />in the property in terms of improvements but she has a problem with forcing an <br />individual who did not create this situation to sell his property for fuir market value rather <br />than being able to make a profit on it. <br /> <br />Council Member Broussard Vickers indicated that the situation was created through no <br />fault of Mr. Carpenter and he is aware that the City and the developer stand to make <br />. money on the deal and is trying to capitalize on the situation. She then said she questions <br />why the developer has not gone to Mr. Carpenter and offered to pay $10,000 which is <br />how much it would cost for the eminent domain proceedings. She further commented <br />that it concerns her that the developer is so willing to pay the attorney's fees rather than <br />settling with Mr. Carpenter. <br /> <br />Council Member Capra agreed that the property is worth $25,000 to Mr. Carpenter but <br />said this has gone on for several years and she does not feel it will be resolved unless the <br />issue is forced. <br /> <br />Council Member Broussard Vickers indicated she would like to have an agreement in <br />place with Royal Oaks for payment of attorney's fees before any attorney time is spent. <br /> <br />Vote: Ayes - 3. Navs - 2 (Swedbere:lBroussard Vickers). Motion carried. <br /> <br />2. Specifications for 2002 Seal Coat Proiect <br /> <br />Motion bv Council Member Nelson. seconded bv Council Member Broussard <br />Vickers to award the 2002 Seal Coat Project to Allied Blacktop for the bid of <br />$34.860.
