CSAH 14 Watennain Bid Award <br /> <br />Motion bv Council Member Nelson. seconded bv Council Member Capra to award <br />the.CSAH watermain bid to Earthbumers for $158.803. <br /> <br />Council Member Broussard Vickers asked whether Mr. Rehbein had agreed to pay a <br />certain amount as part of the developer's agreement or waive his right to contest the <br />amounts. <br /> <br />City Attorney Hoeft said no. <br /> <br />City Engineer Peterson indicated the bids were less than anticipated. <br /> <br />Mayor Swedberg commented that he did not like that people are not informed and not <br />respected in this process. He then said that even though costs are lower than anticipated <br />he does not approve of going through the process getting bids and informing residents <br />what they will pay. <br /> <br />Council Member Broussard Vickers indicated the process has been the same for other <br />assessments within the City. She also indicated that Council held public hearings to take <br />resident input and Council had worked to keep costs low. <br /> <br />Mayor Swedberg commented that it is built into the process that the developer has <br />leverage at the back end of this to contest his assessment and residents have no recourse. <br /> <br />Vote: Aves - 4. Navs - 1 (Swedbem). Motion carried. <br /> <br />Motion bv Council Member Nelson. seconded bv Council Member Broussard <br />Vickers to approve Resolution 02-021. Ayes - 4. Nays - 1 (Swedbem). Motion <br />carried. <br /> <br />4. The Shores Develooer's Agreement <br /> <br />Bart Rehbein of 1659 Lakeland Circle appeared before Council. <br /> <br />Ms. Moore-Sykes indicated that the developer's agreement had been given to Council at <br />the start of the meeting and apologized for the lateness of it but the document was in her <br />email and her computer has been done since May 24, 2002. She then indicated that the <br />document is blank where the park dedication information should be placed. <br /> <br />City Attorney Hoeft reviewed the developer's agreement with Council. <br /> <br />Mayor Swedberg commented that Eagle Pass 2nd had a new requirement for sodding at <br />the curb and asked if that was in this agreement. <br /> <br />Page 8 of23 <br />
