City ofCen1l:rville
Council Meeting Minutes
June 12,2002

City Attorney Hoeft indicated the sodding requirement was covered in the agreement,

Mr, Rehbein indicated he thought the section concerning final grading should indicate
that no certificate of occupancy would be granted without the final grading being
completed rather than saying building permit.

City Attorney Hoeft reviewed that paragraph and agreed that certificate of occupancy
would be more appropriate, He then indicated that Mr, Rehbein's attorney had asked for
permission to post a bond rather than letter of credit but when advised that the City
prefers the letter of credit agreed to that.

City Attorney Hoeft changed the document to state as reviewed by the City engineer
rather than as prepared by because Mr. Rehbein's engineer prepared the document.

Mayor Swedberg asked if the standards for roads are constant. Mr. Peterson indicated
there were different standards for collector streets versus residential streets but said there
are standards for each.

Council Member Capra expressed concern that a certificate of occupancy could be held
up until cable TV and other utilities are in.

Mr. Rehbein indicated he had submitted the information to all of the utilities and said it
would be ideal to have the cable go in now so there would not be a need to dig up the
area again.

City Attorney Hoeft indicated the park dedication fee was left open and said the fee is
$2,000 per lot and there are 10 lots.

Council Member Broussard Vickers indicated that Mr, Rehbein is giving money in lieu of
constructing the trail and that language is not in the document.

Council Member Broussard Vickers asked the City Engineer to come up with a per foot
price for the trail to put in the agreement.

City Attorney Hoeft changed paragraph nine on park dedication to $20,000 calculated to
be $2,000 per lot multiplied by 10 lots and the amount required by the city for trail
contribution per existing trail standards,

Motion bv Council Member Broussard Vickers. seconded bv Council Member
Capra to approve the developer's aereement for The Shores. All in favor. Motion
carried unanimouslv.

5.
