<br />IX SEPARATION. <br /> <br />A. Duration of Employment. Subject to state law on <br />veterans' preference, Minn. Stat. Sec. 181.931 to <br />181.935, and any applicable labor agreement, the City <br />may discharge or separate a temporary or probationary <br />employee from employment at any time for any or no <br />reason. Other employees may be discharged as a <br />disciplinary action, or as set forth below. <br /> <br />B. Resignation. <br /> <br />1. Procedure. Any City employee wishing to leave the <br />Ci ty' s service in good standing shall file with <br />the City Administrator, at least fourteen (14) <br />days before leaving, a written resignation stating <br />the effective date of the resignation and the <br />reason for leaving. Failure to comply with this <br />procedure shall be cause for denying such employee <br />future employment with the City and denying <br />severance benefits. <br /> <br />2. Unauthorized Absence. Unauthorized absence from <br />work for a period of three (3) consecutive working <br />days may be considered by the City Administrator <br />as a resignation, and the employee shall not be <br />entitled to severance benefits. <br /> <br />c. Retirement. No city employee shall be required to <br />retire at any specific age. <br /> <br />D. Severance Pay. Any regular employee leaving the <br />municipal service in good standing after giving proper <br />notice of such termination of employment shall be <br />compensated for all accrued and unused vacation leave <br />and compensatory time, plus an amount equal to one- <br />third of the value of accrued and unused sick leave up <br />to a maximum of 960 hours. <br /> <br />E. Lay-offs. <br /> <br />1. Procedure. After at least two weeks notice to the <br />employee, the City Council may layoff any regular <br />employee when a position is not currently needed <br />but is anticipated to be filled again within one <br />year.
