<br />City of Centerville <br />August 28, 2002 <br />Council Meeting Minutes <br />Council Member Nelson asked for clarification of the sidewalk language on Page 8 of 18. <br />City Attorney Hoeft indicated the only time the City is looking at a parking lot or <br />sidewalk situation is with a temporary permit for operation outside of the premises and <br />Council has the ability, without the language, to either allow someone or not allow <br />someone to utilize a sidewalk or parking lot. <br /> <br />Council agreed the language was fine. <br /> <br />Council Member Nelson indicated there was a reference to financial investigation on <br />Page 10 of 18 that should be removed. City Attorney Hoeft indicated that any reference <br />to a financial investigation should be deleted. <br /> <br />Council Member Nelson asked for clarification on Section 16 on that same page <br />concerning approval by the Commissioner of Public Safety. City Attorney Hoeft <br />indicated that is a state requirement. <br /> <br />Council Member Nelson suggested adding clarification to the language on Page 15 of 18 <br />concerning violations. <br /> <br />Mayor Swedberg suggested that a parenthesis be added and language that says "see <br />addendum" be added. He then said it is the intention of Council that the ordinance does <br />not need to be redone to make minor modifications in the best practices program <br />addendum so he thought it would be appropriate to reference it in the best practices <br />program and date that addendum. <br /> <br />Council Member Nelson suggested saying the most current addendum. City Attorney <br />Hoeft indicated that it would be fine to add the reference to the addendum. <br /> <br />Council Member Nelson suggested indicating on Page 17 of 18 under best practice <br />penalty grid that the licensee reverts to the regular penalty grid at the third violation. <br /> <br />City Attorney Hoeft indicated that language could be inserted. <br /> <br />Mayor Swedberg suggested that the part that starts with training program right above <br />where it lists the mandatory items the last sentence should be deleted as well as the next <br />paragraph. <br /> <br />City Attorney Hoeft indicated there would be no problem removing that sentence and the <br />next paragraph. <br /> <br />Mayor Swedberg commented that the City had substantially rewritten this Ordinance and <br />asked whether it should remain as Ordinance #13 or be renumbered. City Attorney Hoeft <br />suggested keeping it as Ordinance #13 for future reference. <br /> <br />Motion by Council Member Nelson, seconded by Mayor Swedber2 to approve <br />Ordinance #13 - Possession, Sale and Consumption of Intoxicatin2 Liquor, Wine <br /> <br />Pagel4ofl8 <br />
