<br />City of Centerville <br />August 28, 2002 <br />Council Meeting Minutes <br />asked if Council wanted him to present the request to a judge for signature or present it at <br />the next Council meeting. <br /> <br />Council indicated that it should be presented to the judge. <br /> <br />City Attomey Hoeft indicated that the officer was extremely concemed about the <br />occupants health and safety and made that clear in his report. <br /> <br />A resident asked if the report was public information. <br /> <br />City Attomey Hoeft indicated the information was not public at this time. He then said <br />he expected to have an administrative search warrant within a week presented to the <br />judge. He also indicated that at the time the warrant is executed the police and fire <br />departments will be there as well as an Anoka County representative. <br /> <br />Mary Jane Lang of 15559 Peltier said she cannot understand this delay because some <br />years back she owned a lot on the other side of Donna and she had puddles in the yard <br />and could not cut the grass and received a letter from the City indicating that it should be <br />cut or the City would do it and bill her. She then asked why the process is taking so long <br />for this property owner. <br /> <br />Council Member Nelson indicated that the City has mowed the lawn previously as well <br />as clean up the exterior and now the City is trying to do something more permanent to <br />clear up the problem. <br /> <br />City Attorney Hoeft indicated there have been court proceedings involving this property <br />for code violations including the overgrowth of the property and, while that is a concern, <br />right now the concern that is being addressed is not the grass and weeds but the <br />conditions inside the house for the resident. <br /> <br />Council Member Capra indicated this is the first time City officials will have been inside. <br /> <br />A resident asked whether the outside would be dealt with as well as the inside of the <br />property. City Attorney Hoeft indicated the entire property, both inside and out, would <br />be addressed. <br /> <br />Council Member Nelson questioned whether the City needed to review a right-of-way <br />ordinance. Ms. Moore-Sykes indicated the right-of-way ordinance is before the Planning <br />and Zoning Commission for review. <br /> <br />Mayor Swedberg asked that Mr. Peterson and City Attorney Hoeft review it. <br /> <br />Council Member Nelson asked for an update on the two complaints. She then referenced <br />a letter sent by the City Administrator that had asked that the situation be abated within <br />30 days and asked what abated means. Ms. Moore-Sykes indicated that the property <br />owner needs to cut the weeds to eliminate the violation. <br /> <br />Page 16 of 18 <br />
