<br />City of Centerville <br />August 28, 2002 <br />Council Meeting Minutes <br /> <br />Council Member Nelson asked for an update on the complaint from 6961 Meadow Court <br />concerning the sealcoating on his street. Ms. Moore-Sykes indicated his street was <br />sealcoated and he is not pleased with the rocks. Mr. Peterson indicated that, in time, the <br />rocks would all be pushed in. <br /> <br />Council Member Nelson asked for an update on the Glenn Powers property on Quebec <br />Street. Mr. Peterson indicated he had provided a quote from Ro-So Contracting. <br /> <br />Council Member Broussard Vickers asked why the City would pay to assist Mr. Powers <br />with his water issue if it is not going to do the same for the two gentlemen that were just <br />before Council. <br /> <br />Mr. Peterson indicated it is not quite the same thing as Mr. Powers grade is dead flat <br />versus the \ % of the other property. <br /> <br />Council Member Broussard Vickers commented that the dead flat is no more the City's <br />responsibility than the 1 % if a proper plan was approved. <br /> <br />Council Member Capra commented that the grade at the end of the project is lower than <br />what it was supposed to be. Mr. Peterson indicated a lot of low areas were created. <br /> <br />Council Member Capra asked if the City would have inspected the grade. Council <br />Member Broussard Vickers asked how many property owners this involved. Mr. <br />Peterson indicated it involved four property owners. <br /> <br />Council Member Nelson indicated the property owners would need to sue the developer. <br /> <br />Council Member Broussard Vickers suggested sending the bid to them and letting them <br />decide if they want to contract the work. <br /> <br />Council Member Capra asked if the City has a responsibility if the City approved the <br />grade and it is not right. City Attorney Hoeft indicated the City approves the grading <br />plan and, if the City approves a grading plan that is poor, the City may have some <br />obligation. He further clarified that the City approves the grading plan and does not <br />ensure that the final product will match what is on that plan. <br /> <br />Council Member Capra indicated there is a public safety issue with this lot as his sump <br />pump runs nonstop even in the winter and pumps water out into the street that freezes and <br />causes slippery conditions. <br /> <br />Council Member Broussard Vickers indicated the Attorney has said the City has no legal <br />obligation and the City does not have the fmancials to do it. <br /> <br />Council Member Nelson indicated she agreed with sending a letter to them with the <br />suggested fix and letting them know the City cannot pay to fix it for them. <br /> <br />Pagel70fl8 <br /> <br />l <br />
