<br />Council Member Broussard Vickers clarified that if written objection was not received <br />prior to the City Council meeting owners forfeited their rights. City Attorney Hoeft <br />indicated that is correct. ' <br /> <br />A member of the audience indicated he felt the developer was getting a good deal, as the <br />property owners already paid for their wells and now had to pay for water again. <br /> <br />Mr. Jeff Nottum, 7238 Main Street, asked how the open space was assessed since the <br />City was bringing water to Waterworks and The Shores. Mayor Swedberg indicated they <br />were charged for seven lots at $4,330 per lot. Mr. Nottum stated the space has potential <br />for many more than seven. He asked what would happen if they put in fifteen, <br />questioning if there would be a kickback for each of the residents. <br /> <br />Council Member Broussard Vickers indicated there would not. She indicated they <br />weighed both sides when determining number of lots, including lot size. If the City <br />charged them for fifteen lots, they would have to approve that many lots when the <br />property was developed. <br /> <br />Mr. Nottum reiterated they are hoping for a refund ifthat area is developed further. <br /> <br />Motion by Council Member Broussard Vickers, seconded by Council' Member <br />Nelson to close the public hearine. All in favor. Motion carried unanimously. <br /> <br />Mayor Swedberg closed the public hearing at 9:48 p.m. <br /> <br />Motion by Council Member Capra, seconded by Council Member Nelson to <br />approve Resolution #02-056 as presented. All in favor. Motion carried <br />unanimously. <br /> <br />Motion by Council Member Nelson. seconded by Conncil Member Broussard <br />Vickers to close the public hearine for Truth in Taxation. All in favor. Motion <br />carried unanimously. <br /> <br />Mayor Swedberg closed the public hearing at 9:51 p.m. <br /> <br />4. Mr. & Mrs. John Buckbee III, 7381 Peltier Circle - POO/Special Use Permit <br /> <br />The request was withdrawn. <br /> <br />5. Mr. Gerald Rehbein - 20th Avenue South. Lot Split/Variance Request <br /> <br />Mr. Gerald Rehbein stated he was requesting this lot split to accommodate a dog keunel <br />on this property. The lot was split three years ago, but not recorded. Now size <br />requirements are bigger, but he has no additional property to increase the split. He <br />indicated the Planning and Zoning Commission had agreed. <br /> <br />Page 14 of21 <br />
