<br />Mayor Swedberg opened the public hearing at 9:54 p.m. <br /> <br />Council Member Travis indicated the Planning and Zoning Commission had approved <br />this request with a sixty-foot width easement. There is currently a 30-foot easement and <br />they requested 30 more to prevent land locking. <br /> <br />Council Member Broussard Vickers asked if the variance request met the requirements of <br />hardship. Ms. Moore-Sykes indicated the variance was needed due to a failure to record <br />the split originally and the subsequent change in ordinance requirements. <br /> <br />Council Member Broussard Vickers indicated this was not a change in the ordinance, but <br />a rezoning situation that was never completed due to failure to file by Mr. Rehbein. <br /> <br />City Attorney Hoeft indicated this variance does not meet the proper requirements for <br />hardship and the proper way to handle would be to change the zone. <br /> <br />Council Member Broussard Vickers indicated there was a lot of discussion surrounding a <br />Light Industrial zone three years ago when this split was first requested. The City felt <br />there was a need for a compromise between Commercial and Industrial and determined <br />this would fill that need. The City didn't create the hardship, the failure to .file did. <br /> <br />Council Member Travis asked that the Council consider if they want to get this property <br />back on the tax roll or have vacant. <br /> <br />Council Member Nelson asked how they could meet the variance requirements. City <br />Attorney Hoeft indicated the Council would need to change the requirements in the <br />current zone or create a new zone. <br /> <br />Mayor Swedberg asked if it would be possible to add 40 feet from the adjoining property <br />to reach the 200-foot requirement. Mr. Rehbein indicated this would encroach on the <br />building. <br /> <br />After much discussion, the Council recommended the option of putting a road in as far as <br />the driveway of the smaller property, allowing the owner to use the road footage to reach <br />the 200-foot requirement. The road would need to be paved as far as the driveway to the <br />kennel and meet the engineering specifications of the City. Additionally, an easement <br />would need to be granted from the end of the paved area to the back of the property to <br />avoid land-locking the back parcel. <br /> <br />Mr. Rehbein indicated he would speak with the kennel owners and see how they wanted <br />to proceed. <br /> <br />Motion bv Council Member Nelson. seconded bv Council Member Broussard <br />Vickers to close the public hearinl!.
