<br />I <br />I <br />I <br /> <br />I <br />L~_______ n <br /> <br />asking for an extension of time to remedy the problem due to weather and his inability to <br />move the fence until spring. <br /> <br />Motion by Council Member Broussard Vickers, seconded by Council Member <br />Nelson to extend the date of compliance with Ord. 4, Div. 100 until 05/30/03. All in <br />favor. Motion carried. <br /> <br />2. Kellv's Komer Liquor/Tobacco License Renewal (2003) <br /> <br />Ms. Moore-Sykes indicated Kelly's Komer has complied with all requests. <br /> <br />Motion by Council Member Broussard Vickers, seconded by Council Member <br />Travis to approve Kelly's Korner Liquor and Tobacco License for 2003. All in <br />favor. Motion carried unanimously. <br /> <br />3. Quebec Street Drainage Issues <br /> <br />City Engineer Peterson indicated the engineering survey has been completed on Quebec <br />Street. It was determined there is room to drain, with an estimated cost of $26,000. This <br />includes all seven homes, 630 f~et of pipe, removal of fences, etc. Does not include <br />running pipes into yards. <br /> <br />Council Member Broussard Vickers recommended a letter be sent to the seven <br />homeowners, indicating the City would provide a plan but they would need to hire the <br />contractor. She asked if the City would also offer to run the job and assess the <br />homeowner, possibly allowing them to pay over several years. <br /> <br />Mayor Swedberg cautioned about setting a new direction in policy. Would open the City <br />to deal with all water problems, offering engineering expertise and assessment options. <br /> <br />Council Member Capra asked what recourse the City would have if a homeowner put fill <br />in their yard. City Attorney Hoeft indicated it would be a civil suit between owners. The <br />City may be able to press criminal charges for violation of an ordinance, but would hold <br />the burden of proof. <br /> <br />Council Member Broussard Vickers reiterated that to go in between solving the issue and <br />doing nothing she feels it appropriate to offer engineering expertise and assessment <br />options. All seven owners would need to agree to the assessment. <br /> <br />Council Member Nelson reminded the Council of the precedent they would be setting. <br />The City would have to be prepared to offer the same amount of assistance to other <br />neighborhoods. <br /> <br />Council Member Broussard Vickers stated that anyone who can get all of his or her <br />neighbors to agree to an assessment should be offered that option. <br /> <br />Page 18 of21 <br />
