<br />5. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of <br /> <br />this Agreement, no amendments to the City's Comprehensive Plan or official controls shall apply <br /> <br />to or affect the use, development density, lot size, lot layout or dedications of the approved Plat <br /> <br />unless required by state or federal law or agreed to in writing by the City and the Developer. <br /> <br />Thereafter, notwithstanding anything in this Agreement to the contrary, to the full extent <br /> <br />permitted by state law the City may require compliance with any amendments to the City's <br /> <br />Comprehensive Plan, official controls, platting or dedication requirements enacted after the date <br /> <br />of this Agreement. <br /> <br />6. DEVELOPMENT PLANS. The Plat shall be developed in accordance with the <br /> <br />following plans ("Plans") which are on file with the City. The Plans shall not be attached to this <br /> <br />Agreement. If the Plans vary from the written terms of this Agreement, the written terms shall <br /> <br />control. The Plans are: <br /> <br />Plan A - <br />Plan B - <br /> <br />Pheasant Marsh 3'd Addition [mal plat dated March 1,2006. <br />Final Grading and Erosion Control Plan dated 02-10-06 prepared by James <br />R. HiIl(Grading Plan"). <br />Construction Plan for Sanitary Sewer, Water Main, Storm Sewer, <br />Concrete Sidewalk, Concrete Curb, Gutter, Bituminous Surfacing, and <br />Site Grading, Pheasant Marsh 3'd Addition, dated 02-08-06 prepared by <br />James R. Hill ("Construction Plans"). <br />Soils Investigation Report dated November 2000 prepared by Allied Test <br />Drilling. <br /> <br />Plan C - <br /> <br />Plan D - <br /> <br />, <br />7. IMPROVEMENTS. The Developer shall install and pay for the following <br /> <br />improvements ("Improvements") as required by the Construction Plans: <br /> <br />A. Sanitary Sewer System <br />B. Water System <br />C. Storm Sewer <br />D. Streets <br />E. Concrete Curb and Gutter <br />F. Street Lights <br />G. Site Grading, Ponding and Erosion Control <br />H.
