<br />Procedure: To be eligible for PTO leave with pay, an Employee shall report as <br />soon as possible to his or her Department Head the need to take personal leave and <br />its estimated duration. Requests to use PTO shall be received at least tWenty-four <br />hours in advance of the requested time off. This notice may be waived at the <br />discretion of the City Administrator. <br /> <br />Pay-Out of PTO Leave: The rate of PTO pay will be the Employee's regular rate <br />of pay in effect at the time of PTO request. In the event of termination in good <br />standing, all earned PTO will be paid at the Employee's regular rate of pay. <br /> <br />Use of PTO Leave during a Holiday: Holidays occurring during an Employee's <br />PTO leave will be considered a holiday and the Employee will not be charged for PTO <br />on that day. <br /> <br />Coordination of PTO Leave with Family and Medical Leave: In order to allow <br />coordination of Personal Time Off leave with Family and Medical Leave, Employees <br />seeking to take PTO may be required to provide enough information about the purpose <br />of the leave to allow a detp1"min"tion of whether the leave will also qualify for Family <br />and Medical leave. <br /> <br />Waiver of PTO Leave Prohibited: No Employee is permitted to waive personal <br />leave for the purpose of receiving double compensation. <br /> <br />Workers' Compensation: Employees are covered by workers' compensation laws <br />and regulations of the State. In the event an Employee is disabled and is entitled to <br />workers' compensation, the Employee will keep any workers' compensation <br />payments received and will be eligible to receive a bi-weekly pay check equal to one- <br />third (1/3) of the Employee's regular pay through the use of personal leave benefits. <br />In addition, the Employee will be entitled to insurance benefits during a workers' <br />compensation leave. Employees receiving such workers' compensation will be <br />considered working for the purpose of accumulating additional personal leave <br />benefits. <br /> <br />Unused PTO Leave Pay: Any unused Personal Time Off leave may be paid out <br />subject to the following rules and regulations: <br /> <br />(A) The Employee must be in good standing and gtve proper notice of <br />termination in the case of resignation. <br /> <br />(B) Qualifying Employees shall receive pay for all of their unused PTO <br />accumulated at the time of termination. <br /> <br />8.4 Donation of Personal Leave <br /> <br />General: With the expressed written approval of the City Council, City Employees <br />may donate accrued PTO in one-hour increments to fellow Employees experiencing <br />extended time off due to a serious medical problem or condition and who have no <br /> <br />18 <br />
