,-

May 23, 2001
Council Meeting Minutes

following Council Member Capra's suggestion, the developer would need to completely
modify his plans.

Mr. March stated that he suggested to Mr. Quigley to attempt to resolve the issue
regarding maintaining Ojibway Drive prior to coming before Council. Mr. March
suggested tabling this matter in an attempt to allow ample time for the meeting to occur.

Council Member Broussard Vickers stated that most of the residents were unaware or did
not understand the issues surrounding being responsible for a private street. Council
Member Broussard Vickers stated that while these issues are civil issues, she feels if the
City were to take responsibility for the road it would go a long way toward smoothing the
way for the rest of the development.

Mr. March stated that other communities have private streets and in his opinion, the City
did not make a mistake with the original development and the private street. In Mr.
March's opinion there would not be an issue if residents were members of one (I)
association rather than two (2) or three (3).

Mayor Swedberg questioned whether Voyager Court was also a private road. Mr. March
concurred.

Council Member Nelson stated that she felt if the City assumed Ojibway Drive, it would
be setting a precedence.

Council Member Capra stated that she had concerns with the width of the road.

Mr. Hoeft stated that appears that the town home associations are trying to take the easy
way out and request that the City assume responsibility for Ojibway Drive rather than
coming to a mutual agreement between themselves. Mr. Hoeft stated that he does not
mean to say that the request is inappropriate, but sees the matter as the City inheriting a
potential problem. Mr. Hoeft recommended that the City look at what is in the best
interest of the City as a whole, rather than the town home associations.

Council Member Capra questioned whether the City had taken over any private roads in
the past. Mr. March stated that the City had not.

Motion bv Mavor Swedberl!. seconded bv Council Member Capra to table this
matter for further information. All in favor. Motion carried unanimously.

2. 2l't Avenue Update

Mr. March stated that he had scheduled a meeting with representatives from the City of
Lino Lakes to discuss the feasibility report for this project. Mr. March stated that one (1)
of the issues discussed is the fact that the City never signed the Joint Powers Agreement.

Mr. March stated that the Joint Powers Agreement will be revised to take into
consideration the City's standards for roadways and presented to Council for review.
