<br /> <br />STAFF REPORT <br /> <br />DATE: <br /> <br />February 5, 2002 <br /> <br />TO: <br /> <br />PIanning Commission <br /> <br />FROM: <br /> <br />Kim Moore-Sykes, City Administrator <br /> <br />~ <br /> <br />RE: Infunnation on Fence Permits <br /> <br />............................................................................ <br /> <br />BACKGROUND <br />In November, Staffwas asked by a resident to enforce the City's Ordinance regarding <br />fences. It appears that his neighbor had recently constructed a fence on the adjoining <br />property line without seeking permission from the resident as is required by the <br />Ordinance. When the neighbor was contacted about the situation, he said that he <br />constructed the fence because the other's dog was always off leash and running loose in <br />the neighborhood. He said that he had children who are afraid of the large dog and he <br />wanted to keep it offhis property. The resident that constructed the fence also indicated <br />that it's against the Ordinance to have one's dog off leash. Eventually, the situation <br />escalated to the point that Staff advised the police of the situation. The neighbor with the <br />fence has agreed to remove it in the spring, but insists that the dog must be restrained. <br />Attached is a copy of the fence ordinance, again from the City of St. Anthony's City <br />Code. . <br /> <br />RECOMMENDATION <br />Staffis recommending that the PIanning and Zoning Commission revising the current <br />fence ordinance that would require a building pennit for the construction of a fence and <br />that a site plan be included as part of the review process so that disputes between <br />neighbors of this nature are avoided. A pennit fee will have to be established as well for <br />the inspection of the structure. <br />
