Facility Use Agreement <br /> This agreement is made on , 1999, between the City of Centerville <br /> ( "City") and Centennial/Chain of Lakes Little Leagues ( "Leagues "). <br /> The City owns property known as LaMotte Park ( "the site "). The facilities at this site include <br /> three ball fields (with bleachers) and a bathroom/concession building. The City has limited resources to <br /> program recreational activities at the facilities. The Leagues have offered to program and administer <br /> certain recreational activities at the facilities for the benefit of City and surrounding community residents. <br /> This agreement contains the conditions governing this arrangement, as authorized by Minn. Stat. <br /> &471.16. <br /> 1. Use of the Facilities. The City will make the facilities available to the Leagues at no charge for <br /> youth baseball and softball programs ( "the programs "). The City will provide the following <br /> for the facilities: weekly mowing, fertilization, weed control, fall turf refurbishment, turf <br /> irrigation, parking lot maintenance, trash cans and trash collection. The dates and times that <br /> the Leagues may use the facilities must be scheduled by April 1 of each year. Any use of the <br /> facilities for tournaments must also be approved by the City of Centerville. <br /> 2. Operation of the Program. The Leagues will organize, operate and administer the program in <br /> compliance with the requirements of this agreement. The Leagues will provide the following: <br /> site clean-up, line striping, and the necessary personnel, equipment and supplies for the <br /> program. The Leagues will be responsible for supervising the activities which are part of the <br /> program and ensuring that no unreasonably dangerous activities are allowed to occur. The City <br /> reserves the right to correct and eliminate any unreasonably dangerous practices or activities <br /> undertaken by the Leagues. The Leagues will immediately advise the City of any physical <br /> conditions which appear to make the facilities unsafe. They will not allow continued use of <br /> the facilities under unsafe conditions. They will also promptly notify the City of any injuries <br /> or property damage which occurs at the facilities during program activities. They will not use <br /> the facilities for any purpose other than the programs. <br /> 3. Compensation. The Leagues will organize, operate and administer the programs at no cost to <br /> the City. To cover its costs, the Leagues may charge reasonable fees for participation in the <br /> programs <br /> 4. Modifications to Facilities. All improvements and facilities which exist on the site are the <br /> City's property. The Leagues may not make any modifications or improvements to the <br /> facilities without prior written approval from the City. Any modifications or improvements <br /> become the property of the City. By entering this agreement, the City does not commit to <br /> making additional improvements to the site; however, the City agrees to consult with the <br /> Leagues before it makes any modifications or improvements to the site. <br />
