SECTION V <br /> POLICE DEPARTMENT EQUIPMENT, <br /> LAND AND BUILDINGS <br /> 5.1 Equipment. Each of the cities to this agreement has contributed to the Department <br /> for its use and benefit, the cities' existing police equipment. The Police <br /> Commission shall control the use of such contributed equipment. All expenses <br /> relating to the maintenance and repair of such equipment shall be an operating <br /> expense of the Department. <br /> 5.2 Land and Buildings. Each of the cities to this Agreement may provide building <br /> space to the police department. Such land and/or building space may be owned <br /> by the City and leased to the police Department. Such lease is to be an operating <br /> cost of the Department. Any lease requires the approval of all member cities.. <br /> Existing leases will be honored. The Commission shall control use of the <br /> buildings and land. <br /> 5.3 Ownershiu. New and used equipment purchased by the Department after the <br /> effective date of the original Joint Powers Agreement (January 1, 2000) shall be <br /> owned by the Department. The Department's Chief of Police shall conduct an <br /> equipment inventory annually and present such information to each member city. <br /> 5.4 All equipment controlled by the Department shall be used when needed within the <br /> boundaries of the District for the benefit of the member cities. They should not be <br /> used outside the District, except as follows: <br /> (a) In areas outside the District, when police emergencies may endanger life or <br /> property within the District. <br /> (b) When use is covered by contracts duly entered into by the Department for <br /> police services or other services outside the District. <br /> (c) When necessary to fulfill mutual aid agreements duly entered into by the <br /> Police Commission. <br /> (d) In case of major emergency or disaster, when authorized by the Chief of <br /> Police, or in his absence, the officer in charge. Such use shall be reported as soon <br /> as possible to the Chief of Police of the Department. Such use, as authorized <br /> above for use outside the District, shall be carried out only when the officer in <br /> charge has determined that the absence of equipment from the Department will not <br /> impair the protection of the District. The officer in charge shall have the authority <br /> to determine priority in answering calls and to assign equipment and manpower. <br /> 6 <br />
