Motion by Council Member Nelson, seconded by Council Member Broussard Vickers to <br /> approve the animal control contract submitted by Otter Lake. All in favor. Motion carried <br /> unanimously. <br /> 5. Minute Taking (TimeSaver) <br /> Motion by Council Member Nelson, seconded by Council Member Travis to approve the <br /> minute taking contract submitted by Time Saver. All in favor. Motion carried unanimously. <br /> 6. Public Works Staff/Union Agreement <br /> Motion by Council Member Nelson seconded by Council Member Travis to table this item <br /> for discussion at an executive session following the regular meeting. All in favor. Motion <br /> carried unanimously. <br /> Hasiak Building Permit <br /> Mr. March explained he had heard from the Hasiak's who had informed him they did not wish to <br /> obtain a building permit due to financial constraints at this time of year. <br /> Mr. Hoeft stated he had spoken to Mr. Palzer concerning the matter and it is unclear as to whether <br /> or when the Hasiaks would obtain the building permit. The City does have the legal remedy to <br /> begin the process to declare the building a hazardous structure, which would require the Hasiaks to <br /> either get the permit and have the wiring inspected or risk having the City tear down the building. <br /> Mr. Hoeft recommended setting a timeline for the Hasiaks to obtain the building permit and then <br /> commencing a hazardous building action should the Hasiaks not obtain the permit. <br /> Council Member Sweeney suggested a six (6) month time limit be set for the Hasiaks to obtain the <br /> permit. <br /> Council Member Broussard Vickers questioned whether the lean to had been torn down. Mr. <br /> March indicated that it had not. <br /> Council Member Broussard Vickers questioned if Staff believed the structure to be a hazard and <br /> Mr. Hoeft stated that staff has been unable to inspect same without a building permit. <br /> Council Member Broussard Vickers questioned the distance to the nearest house from the <br /> structure and if the City had any legal liability in the case of a fire. Mr. Hoeft stated that there had <br /> been no problems up to this point and no inspections had been completed. <br /> Council Member Broussard Vickers stated she could understand not wanting to pay for the permit <br /> but did not understand why the "lean to" had not been removed. Council Member Broussard <br /> Vickers stated she did not believe there had been any good faith on the part of the Hasiaks. Mr. <br /> March stated he had been told the Hasiaks were considering leaving the "lean to" up for a dog <br /> shelter. <br /> Council Member Sweeney stated it was his understanding the "lean to" was to be removed. <br /> Mayor Wilharber suggested sending a registered letter to the Hasiaks giving them a time period to <br /> obtain the building permit and informing them the "lean to" would need to be tom down <br /> immediately. <br /> Page 11 of 14 <br />
