P &Z Meeting Minutes <br /> April 22, 1991 <br /> page four <br /> A copy of Greg Hellings ", City Attorney, letter dated April 10, <br /> 1991 regarding the Richard W. Tuomi variance request is on file <br /> with the Clerk /Administrator. <br /> Commission member Vermeulen expressed that in her opinion the <br /> enlargement of the garage could be an improvement /benefit for the <br /> property owner and the City. <br /> Commission member Welk expressed that she felt it could look <br /> better to have the garage enlarged. Commission member Welk <br /> questioned the zoning (C -1 Conservation District) of the <br /> property. <br /> Chairperson Tourville noted that State law does not permit the <br /> granting of a variance for the use of a property. Mr. Tourville <br /> noted that he would be in favor of rezoning the property to <br /> residential, providing the property is not in the flood plain. <br /> Chairperson Tourville would like the City Engineer to comment on <br /> whether the C -1 Conservation Zoning District follows the 100 year <br /> flood plain. <br /> It appeared to be the consensus of the Planning and Zoning <br /> Commission that they would be in favor of rezoning the property <br /> if the property owner were to request it be rezoned. <br /> Mr. Tuomi stated that he would be in favor of requesting the <br /> property be rezoned. <br /> Jerry Helmbrecht, 1745 Main Street, questioned why the property <br /> had been rezoned from Residential to Conservation. <br /> Commission member Wilharber expressed that at the time the City <br /> was looking for areas of the City that could be used for future <br /> park land or a trail system along Clearwater Creek. Concern also <br /> was for the flood plain. <br /> Tamara Miltz- Miller, Clerk /Administrator, was present. Ms. <br /> Miltz- Miller noted that the Flood Plain Reduction Study should <br /> not decrease the flood plain area on the Tuomi property. <br /> Chairperson Tourville advised Mr. Tuomi to get elevation of the <br /> site of the new garage site. <br /> Ms. Miltz- Miller noted that Mr. Tuoumi should have a certified <br /> Surveyor certify that the property is out of the flood plain. <br /> It lys nptpd thpt nhnuld the property be rezoned to residential, <br /> variances would still be required to expand the garage.
