The following land divisions are <br /> exempted from the provisions of Ordinance #8, Section 21.05 and <br /> upon request, the City Clerk shall within ten (10) days, certify <br /> that this subdivision does not apply to such land divisions; <br /> (1) Divisions of land where the division is to permit <br /> the adding of a parcel of land to an abutting lot and the newly <br /> created property line will not cause the land or any structure to <br /> be in violation of this Ordinance or the Zoning Ordinance, and <br /> that the proposal would not have an adverse impact on the subject <br /> property or surrounding properties. <br /> (2) Said division and addition of land will not be <br /> large enough to allow for the creation of an additional lot for <br /> the purpose of building. <br /> (3) In the case of a request to divide a base lot upon <br /> which a two family dwelling, townhouse or a quadraminium which is <br /> a part of a recorded plat where the division is to permit <br /> individual private ownership of a single dwelling unit within <br /> such a structure and the newly created property lines will not <br /> cause any of the unit lots or the structure to be in violation of <br /> this Ordinance or the Zoning Ordinance. <br /> (4) If the Clerk /Administrator makes a negative <br /> determination or the applicant wishes to appeal the decision, the <br /> case shall be sent to the Planning and Zoning Commission for <br /> recommendation to the City Council. <br /> motion carried unanimously. <br /> NEW BUSINESS <br />
