P&Z Meeting Minutes <br /> December 4, 1990 <br /> page four <br /> Pursuant to due call and notice thereof the Planning and Zoning <br /> Commission of the City of Centerville held a public hearing at <br /> the City Hall on Tuesday, December 4, 1990. The purpose was to <br /> hear all persons present regarding a request for a variance from <br /> Ordinance #8, Article 2, Section 21.05 RESTRICTIONS OF FILING AND <br /> RECORDING CONVEYANCES. (6) Is a single parcel of residential or <br /> agricultural land not less than twenty (20) acres in area <br /> and having a width of not less than five hundred (500) feet, <br /> and its conveyance does not result in the division of the <br /> parcel into two or more lots or parcels, any one which is <br /> less than twenty (20) acres in area of five hundred (500) <br /> feet in width." <br /> The request is for a lot split to increase the east side yard set <br /> back to the following property commonly known as 1337 Mound <br /> Trail. Chairperson called the hearing to order at 8:10 p.m. <br /> Present: Drilling, Welk, Vermeulen, Wilharber. <br /> Chairperson Tourville summarised the request to members_ of the <br /> Commission and audience. <br /> Chairperson Tourville stated that, in his opinion, this is a re- <br /> alignment of property lines not a subdivision, The realigning of <br /> the property lines does not create a sub - standard lot. It would <br /> be benefit to the property owners and the City by making the <br /> property conform to the side yard setback requirements. <br /> Art Mohler, 1756 Peltier Lake Drive, Angelo and Grace Stella, <br /> 1337 Mound Trail, were present. Mr. Mohler expresser) that Mr. <br /> and Mrs. Stella would like to increase their east side yard <br /> setback to allow access to the lake side of their home. <br /> Motion by Wilharber, second by Welk to adjourn the public <br /> hearing, motion carried unanimously. Hearing adjourned 8:17 p.m. <br /> Chairperson Tourville opened the regular meeting. <br /> NEW BUSINESS <br /> Variance request - 1337 Mound Trail <br /> Motion by Wilharber, second by Welk to recommend to the City <br /> Council approval of the Angelo and Grace Stella`s request for a <br /> variance from Ordinance #8, Article 2, Section 21.05 RESTRICTIONS <br /> OF FILING AND RECORDING CONVEYANCES. (6) to increase the east <br /> side yard set back for the following reasons: <br /> - It benefits the property owner and the City to remove <br /> the non conformity of the east side yard setback; <br /> - Does not create a substandard lot; <br /> - Both property owners are in agreement; <br />
