Meeting Minutes P c& Z <br /> Page Two <br /> would not impair his neighbors who are 31 feet north of his <br /> property line, and have no objections. <br /> Commission members discussed the size of Mr. Perkowski "s present <br /> non- conforming nine foot deck and noted Mr. Pettersen"s comments <br /> on this at the October 3, 1989 meeting stating that he could not <br /> replace a non - compliance with a more non - compliance. Chairman <br /> Tourville disclaimed the statement made by Mr. Perkowski that <br /> there were no sideyard setbacks at the time the deck was built, <br /> citing Ordinance #10 April 1961 was in effect with the same 10 <br /> foot sideyard setback as Ordinance #4 enforces today. Chairman <br /> Tourville also noted that the deck was not a result of his <br /> actions, but anything new would be the result of his actions. <br /> Enlarging of a non - conforming deck is prohibited unless there is <br /> a uniqueness. <br /> Commission member Drilling noted that the variance granted at <br /> 1850 Fox Run was different due to the fact they are on a corner <br /> lot and given the wrong information as to where they could build. <br /> Motion by Drilling, second by Welk to take a no action vote, that <br /> Mr. Perkowski be allowed to go in front of the City Council with <br /> no recommendation from the Planning and Zoning Commission, motion <br /> carried unanimously. <br /> Discussion on the open position Planning and Zoning Commission. <br /> Motion by Drilling, second by Vermeulen to take a vote at a <br /> closed meeting following the regular meeting, motion carried <br /> unanimously. <br /> NEW BUSINESS: <br /> Discussion on the Hardwood Ponds 2nd Addition. Gerald Rehbein <br /> was present. Mr. Rehbein stated that there were no changes and <br /> would like to have his sketch plan and preliminary plot approved. <br /> Hardwood Ponds is recommended for MUSA expansion and rezoning. <br /> Liaison Neumann noted that the Comprehensive Plan is approved. <br /> However, City Council is investigating recommendations by the DNR <br /> and Rice Creek Watershed for amendments. <br /> Motion by Drilling, second by Vermeulen to recommend to the City <br /> Council approval of Hardwood Ponds 2nd Addition sketch plan and <br /> preliminary plot contingent upon rezoning of property to R2A and <br /> MUSA expansion, motion carried unanimously. <br /> Discussion of the possible variance for the development on the <br /> south side of Main Street. Gerald Rehbein was present. Mr. <br /> Rehbein would like to have the 85 foot fronts, with deeper lots, <br /> keeping the 15,000 square foot lots. <br />
