<br />Planning and Zoning Minutes of May 7, 1996 <br /> <br />OLD BUSINESS <br /> <br />Barott Lot Split / Variance <br /> <br />Tourville commented that the county already has the comer lot and would be opposed to <br />selling the existing homes to the county and giving up a beautifullakeshore site for a <br />home. Tourville also added that he would like to see the area turned back into a beach <br />again. <br /> <br />Mr. Barott stated that he is being cautious on selling is that Mr. Ivan Barott would have to <br />pay capitol gains on property sold. <br /> <br />There was some discussion on the history of the homes on Main Street. <br /> <br />MOTION by LaMotte, second by Welk to approve the Barott lot split and necessary <br />variances, contingent upon clarification of the city engineer regarding the drainage and <br />utility easements. Motion carried unanimously. <br /> <br />Ordinance 4 & 44A <br /> <br />P&Z discussed Mr. Patzer's memo on minimum area of structures. <br /> <br />Tourville stated that he had spoke to Dean Johnson about working on this ordinance once <br />the comp plan is complete. <br /> <br />P&Z concluded that back a number of years ordinance 4 went through a similar <br />amendment phase but that public hearings were never held to make changes. Staff is <br />requested to research this to find the marked up copy of ordinance 4. <br /> <br />MOTION by Tourville, second by LaMotte to table Ordinance 4 and 44A. Motion carried <br />unanimously. <br /> <br />NEW BUSINESS <br /> <br />Safety Concern - Aerator <br /> <br />Trudi Breuninger described the complaints that were filed last fall regarding the aerator <br />keeping the pond open, keeping kids from ice skating. The city does not have any <br />easements along the pond or to the pond. Because the entire pond is on private property - <br />each lot owning a portion of it, it would be the Attorney's position not to get involved. <br />This would just put the city into liability. <br /> <br />Wilharber added that it may be an issue under the nuisance ordinance, but stated his <br />opinion a judge would throw it out. <br /> <br />PZ5-7MM.WPS <br /> <br />4 <br />
