E-Mailed to Council on 5/3/O1 at 11:34 a.m. <br /> Apri125, 2001 Council Minutes <br /> Ms. Kathy Peil, 1859 - 73 StI'2�t stated that her and her husband have been trying to <br /> build an in-ground pool in their backyard for two (2) years. Ms. Peil requested that <br /> Council agree to release her building permit on Tuesday, May 1, 2001 pending a <br /> favorable outcome at the Planning and Zoning Commission meeting regarding Ordinance <br /> #4 amendments and requirements for pools. <br /> Council Member Capra questioned Mr. Hoeft whether the City could legally agree to <br /> comply with Ms. Peil's request. <br /> Mr. Hoeft suggested releasing the permit subject to the approval of the Planning and <br /> Zoning Cornmission. Mr. Hoeft also suggested that if Council had concerns in regards to <br /> pool requirements, they should address same at a special meeting or attend the Planning <br /> and Zoning Commission meeting. <br /> Council Member Broussard Vickers questioned the approval of Council prior to the <br /> process being completed. <br /> Council Member Travis clarified that pools are not currently addressed in Ordinance #4 <br /> and Staff is treating them as an Accessory Structure. I <br /> I <br /> Mr. Hoeft stated that Council has the authority to release the permit. Mr. Hoeft also � <br /> stated that this request is not a Variance and is not governed by Ordinance #4. <br /> I <br /> Mayor Swedberg questioned the feelings of Ms. Peil's neighbors. Ms. Peil stated that she <br /> had discussed the pool and required fencing with her neighbors as signatures would be <br /> required to install the fencing on the property line. I <br /> Mayor Swedberg questioned whether additional pool requirements would need to be in I <br /> place if Ordinance #4 is amended regarding pools. Council Member Broussard Vickers <br /> stated that most pool requirements are covered under building codes and state law. I <br /> I <br /> Mayor Swedberg suggested calling a special meeting the night of the Planning and <br /> Zoning Commission meeting to discuss this matter. <br /> Council Member Nelson suggested a telephone vote. Mr. Hoeft stated that a special <br /> meeting or a telephone poll would need to be published. <br /> Council Member Travis stated he felt this was a formality and he was fine with approving <br /> the release of the permit contingent upon Planning and Zoning Commission approval. <br /> Ms. Peil questioned the possibility of residents raising concern with the amendments to <br /> Ordinance #4 regarding the pool requirements subsequent to approval and during the <br /> publication period.
