sweeping of the roadway_ Magnuson then requested guidance from the council regarding Big Fox Road at <br />the Anderson driveway (3646 Big Fox. Road), 'stating that Mrs, Anderson urged Schifsky workers to add a <br />ramp into the roadway at her driveway. Workers stated that Mrs. Anderson became belligerent and insistent <br />that the work be done. Following discussion and upon motion duly made (Igo) and seconded (Kunin), the <br />council voted by a vote of 4 Ayes, 0 Nays, and 1 Abstention to have the ramp removed for the following <br />reasons: 1) the ramp is exceptional to the as built condition of the road; 2) the ramp could potentially cause <br />damage to road maintenance equipment which would represent a liability to the City; 3) the ramp could <br />represent potential damage to the roadway if water were diverted into the roadway from the curb; 4) the <br />work was not ordered by the City from the City's contractor, but rather by a private party not entitled to <br />order such work on the City's behalf Magnuson was directed to communicate with Schifsky and require <br />removal of the ramp and restoration of the area consistent with the as built design of the roadway. <br />Emeott reported that he believed 1.996 septic inspections were complete. <br />Magnuson then reported that. Vadnais Heights has passed a Model Telecommunications Ordinance <br />as published in the White Bear Press of 11 September 1996. He further stated that these ordinances are <br />designed to control placement of telecommunication towers in cities as well as assure that potential income <br />from their placement is controlled by the cities. Magnuson then asked if our zoning ordinance was adequate <br />to restrict construction of a telecommunications tower in the City. Mayor Emeott stated that a separate <br />ordinance would most likely be required. The Clerk was directed to draft an Ordinance. <br />Discussion then followed regarding the dirt bike ordinance requested by. Birkebak. Magnuson stated <br />that he felt modification of the snowmobile ordinance would be better than a specific ordinance related to dirt <br />bikes. With concurrence, the Clerk will draft amendments to the snowmobile ordinance: <br />Magnusonthen reported that an ordinance requiring businesses to have occupancy permits in the city <br />must be developed prior to 1997 as income from this has been included in the 1997.(proposed) Budget. <br />Magnuson then reported that the Ayde property has been secured for a payment of $154.15. <br />Magnuson then presented the Preliminary Proposed 1997 Budget and 1997 Proposed Tax Levy. <br />Following discussion and upon motion duly made (Igo) and seconded (Nielsen), both items were unanimously <br />approved as presented, including a 1997 Proposed Tax Levy of $90,000. Magnuson noted that fine tuning <br />of these will take place between now and. December when a final levy will be adopted,. <br />Magnuson then reported that only the incumbents have filed for the November General Election and, <br />thus, will run unopposed, <br />Magnuson then reported that 34 voters participated in the primary representing only 12,3% of the <br />276 registered voters. <br />Discussion then followed regarding the noise problem being presented to residents along Goose Lake <br />Road by the continuing operations and employees of Custom Thermoform located north of the city's <br />residential boundary. Letters from 7 residents in the area complaining about Iate night operations and <br />employee parties/general noise were presented_ Magnuson indicated that he and Igo should meet with both <br />Custom Thermoform and White Bear Township to discuss the matter and look to achieve resolution not later <br />than April, 1997.. <br />Magnuson then asked the council for a resolution on billing auto dealers for VIN checks performed <br />2 <br />
